I am declaring my car SORN but I want to keep it taxed as it will be back on insurance cover next week more than likely. What I do not want to do it get a partial refund for tax for April and then have to pay for the whole month of April again in a weeks time.

I cannot believe that you now have to declare SORN when a vehicle is not insured even if it has tax and is off road and garaged and NOT going to be on the road !!!!!!!!!!!!!!!!!!!!!!!!!

And you won't get a partial refund for April. You will pay for April in full, twice.

If you declare SORN now, you wouldn't receive anything back for April as only whole unused months are refunded.

You wont get a partial refund for April, you'll lose the whole month and if you tax it from the beginning of April again (if you can that is) you'll be paying twice.
Edited, what SS2 said.

Just leave it taxed, a few weeks uninsured with tax will be fine.

Thank you to all although most have missed my point. Firstly, I know that I will only get a refund for the full months ie May onwards. I also know that if I want to use the car at the end of April I will have to pay for the whole month again !!!

Someone told my wife (Aviva) that if I did not renew my insurance I have to SORN the vehicle even though it is taxed and off road. This was NOT my understanding of SORN but then read on some money site that from 2011 the new law was you had to declare SORN if it was either not insured or not taxed.

Is this the case or not??????????

To reiterate the car will remain taxed and off road but worry that if I declare SORN they will refund my tax whether I want it back or not. Is this the case??

I just do not want to renew my insurance just yet - Heeeeeeeeeeeeeeeeeeelp.

Two questions for any experts.

As mentioned before, and on the money site you reference, it's been the law for the last 4 years that if the car has tax on it, regardless of whether or not it is parked on the road, then it must have an insurance policy in place.

If you don't want to insure the car, then you need to take it off the public road, park it on a drive / garage, etc, and declare it SORN, and then DVLA will issue a refund for any remaining months of tax that are left.

From the MIB website (At this Link http://www.mib.org.uk/Motor+Insurance+Database/en/...

Continuous Insurance Enforcement (CIE)

As part of Continuous Insurance Enforcement (CIE) it is a legal offence to keep a vehicle without insurance unless you have notified DVLA that your vehicle is being kept off the road by means of a Statutory Off Road Notice (SORN).

You don’t have to be driving to be caught.

Under the CIE system, MIB and the DVLA are working in partnership to identify uninsured vehicles by comparing DVLA vehicle records against those held on the Motor Insurance Database (MID).

The registered keeper will be sent an Insurance Advisory Letter (IAL) telling them that their vehicle appears to be uninsured and warning them that they will be fined unless they take action. If the keeper fails to comply with the advice set out in the letter they will face:

• a fixed penalty notice of £100
• their vehicle being clamped, seized and disposed of
• a court prosecution with a maximum fine of £1,000

These insurance enforcement measures are in addition to the powers the police already have to seize an uninsured vehicle and fine the driver.

You can check your vehicle has a valid insurance policy on the Motor Insurance Database by using our FREE service at www.askMID.com

For more information on CIE please visit https://www.gov.uk/vehicle-insurance and see relevant press releases in the MIB Media Centre.

Thank you. That is complete b#ll#cks. I really do not see why a driver has to surrender their tax disc if they do not want to insure their car even if it is off the road.

I am quite sure that I have been SORN ing my cars over the last few years and putting the tax disc in with or without insurance.

If the Government wants to have it both ways they should be refunding pro rata and NOT rounding up whole months. Why has this not been contested in court? What happened to unfair contract conditions 1977 ??????

This is a clear SCAM of the car owner!!!!

And this link for a full explanation of the SORN rules.

https://www.gov.uk/sorn-statutory-off-road-notific...

As I said in my first reply and perhaps I should expand;

SORN or Tax/Insurance that's about it, the one exemption revolves around MOT's where you can have insurance but no tax and you can then drive to a pre-booked MOT but that's not what you are asking is it.

Yes, you're right. Why don't you give them a call tomorrow and explain all that. I'm sure they'll see the errors of their ways and change things

Btw sorning a vehicle generates an automatic refund of unused months' tax. Always has done. Why would it not?

This just shows the lack of understanding people have. A car is either taxed or SORN p, but not both. It's been like that since SORN came into play about 15 years ago. Why the outrage now?

Language a bit uncalled for, but I understand your sentiment, Google is your friend in this circumstance, now if PH fixed their search function we might have less of these repeat questions (but we both know that isn't going to happen).

LoonR1 you can usually read between the lines autism or not however I shall clarify. I always knew SORN generated a tax refund. I live/work abroad and have been 'SORN ing' my cars for the last ten years. Hopefully that is clear to the last few posters too. I am quite sure that I have also had laid up cover (Fire & Theft only) and gaps in cover where cover was really was not needed ie the car is in a locked garage.

The change now is you have to declare SORN if it is not insured even if you want to keep it taxed. Why would anyone want to refund their tax for 7 days only to pay for 30 days again for the last 11 days ????

Fair enough they want me to SORN but I do not want to get a refund to have to pay again. I just want to keep my tax and keep the car off road without insurance whilst keeping DVLA happy.

Surely the HMG should have allowed a new type of SORN that allows you to tick 'I want to keep my tax running'. It would not be difficult really would it?

Don't worry about the insurance. They send a letter first, it takes them a month to get themselves sorted. So you have a month to get yourself sorted.

Don't drive the car on the public road and if you are only messing about with a week or two don't worry about sorning. Keep it taxed. Less chance for admin errors and extra cost.

The police are only interested if you drive the car on the public road which is what the stupid numpties do. Don't be a numpty and for 4 weeks plus you will be ok.
