Help prison sentencing
Discussion
Can the PH collective please help me with my daughters home work? the question she has is what is the maximum sentence for persistant theft and burglary. What kind of world do we live in when this kind of question represents homework oh well i suppose it gives some one the chance to show off their knowledge of the prison/legal system. We have checked various reference books without success and can't seem to find a web site to help.
Thanks

Does the question specify country
Maybe a compare and contrast about the levels of re-offending vs the harshness of punishment (think Saudi)
Should give the (guessing) lentilist teacher something to chew on
>> Oh and I think it's theoreticaly 5 years but that's out in 2 and a bit

If you have a job, then life imprisonment.
If you're theiving, dole bludging, chav, pregnant at 13, superking smoking, special brew drinking, illegal car driving, sofa throwing council estate scum then you get let off, or taken on holiday. innit.

For her to get top marks I'd also ask her what type of person her teacher is, if it's a wet liberal then tell her to add on a bit about the "importance of rehabilitation". If the teacher is a normal person like us then get her to add a bit along the lines of "whatever it is, it's no long enough".

Off the top of my head it's 7 years for theft and 14 years for a dwelling burglary, 10 for non-dwelling ![]()

I've just checked and it appears my memory serves me right (good job really!
). Relates to Crown Court powers for an adult, obviously Magistrates' powers are much reduced and sentencing for youths is another story. In reality the maximum sentence is rarely passed. A substantial reduction is given for a guilty plea and even if the maximum were to be given they are released somewhere between half way and two thirds, or possibly even earlier on one of our Home Secretary's hair brained schemes....but don't start me off on that
I'm assuming your daughter doesn't need too much of an in depth answer but if there's anything else I can help her with just let me know
Jo
As stated...
Theft is 7 years at crown court or 6 months at mags court.
Burglary dwelling is 14 years at crown or again 6 months at mags. Non dwelling is 10 years or 6 months at mags.
Burglary with intent is triable crown court only and is 14 years dwelling or 10 years non dwelling.
Aggrivated burglary - triable at crown only and i think carries no maximum sentance.
We also have the new sentancing act for burglary which says the 3rd conviction for dwelling burglary carries a min sentance of 3 years - max 14 years at crown only.

Don't want to be pedantic but that's not right. Aggravated burglary is indictable only as is the 3rd domestic under Powers of Criminal Courts Act but burglary with intent is either way.
Sorry.....I can be such a
at times

Edited to add: it's maximum of 'life' for aggravated burglary

If only that were true. The 'life' for a second serious offence sounded great in theory but in practice it's almost laughable.
Life with a recommended sentence of 6 years ie out in 4 at the most is one I've had recently. How does that make sense?

I have a PYO who makes it his business to wreck the cells at the YOI where he usually resides.
He has done it several times, causing £1,200 damage on each occasion.
He does it with impunity, in the certain knowledge that the offence is non imprisonable for a youth.
The YOI staff are tearing their hair out....
Thank God he turns 18 in a couple of months.

Pesky PYOs.
Four of em in court today for beating 7 bells of sh1t out of people indiscriminately. Kicking and stamping on heads etc. Nasty so and so's. Still, won't be doing it again for a while.
What with them and the man with a fetish for surgical masks it's been quite an interesting day....
