Hi, I got caught doing 109 MPH on a Fixed Camera at the end of the M6 Toll Way (junction where it joins the M42).

What is the likely penalty likely to be. I presume I'll be asked to go to court.

Would legal representation aid my case of escaping a ban? Also any ideas on fines?

Also is there any likely hood the camera may have registered an inaccurate speed?

Hang on a minute, there is no link from M6 toll to M42. There are cameras along the A449 at Shareshill for both the 40 and 30mph limit. Then onto the m54 that have until recently been average speed cameras covering the works for the JLR factory at i54.

Do you mean a fixed camera or a mobile? or worse one in the 30/40 limit?

So how do you get from the M6 Toll to the M40?

I come down the M6 Toll, then onto the M42.

At the point they merge (and a bit before/after) there are a series of overhead gantry cameras.

Glad I take it easy through there now i.e. never above 80mph - and will be extra vigilant now I know they work.

P.S. I'm assuming you passed through at this speed whilst no speed was shown on the overhead gantries?

It was before I got to the speed limit flashing limits on M42. This was when the M6 Toll merges with M42. Apparently those cameras only go off when your going above 101 MPH.

I see. Bad luck then bud. Nothing to do but cross fingers and pray.

Should cost you about a week's earnings plus the victim tax. Ban one to eight weeks or half a dozen points if you get a good case together.

What is worse for insurance purposes, 6 Points or a ban for 1 month let's say?

Ask for photographic evidence?

If theres a clear photo of you in the vehicle driving then you're buggered basically.

However if it is not clear then you can argue it could've been you or another insured driver. smile

If you can string letters past 6 months you'll get away with it.

But due to the speed caught at they'll probably treat it as a high priority case so are probably more likely to get a swift reply. And therefore less chance of getting away with it, if they can't identify or prove who the driver is they have no case - they can't legally prosecute 2 drivers for one crime.

Years ago I got caught at 104 on the A1, had a solicitor and asked him to get me a ban as I could work from home, less hassle for me, but ended up with 6 points and a big fine, so I'm not sure that legal representation for this sort of thing is necessary or good, just costs you more money, unless like me the solicitor forgets to invoice you !

If it's your first ban I think it's relatively short (couple of weeks ?) and they can't ban you if you'll lose your job if banned.

I spoke to some legal person who deals with this who stated for this speed it could be 2 months ban.

Would it therefore be no point appointing someone?

Hopefully the court will not give you a quick punishment such as a ban but give you 11 points so they will be sure you will not be speeding for the next 3 years.

Depends on how good they are - 2 months is the maximum ban for a single speeding offence IIRC, so it could be a bit less than that if you (or your solicitor) manage to persuade the magistrates that you are feeling very contrite. If not having the car for 2 months is going to be a real problem then it'll probably be worth it.

Out of interest, how do you know this?

(Apart from receiving a NIP of course).
