i was driving round the m25 at a reasonable speed above the limmit but below 100 about midnight. Came up to juction 9 and there was 1 police car on the junction and 1 car about a mile down the road neither of them made any effort to chase me, can they send me a ticket in the post if they have the reg of the car? and if they do how can they prove i was there?

How can you prove you were not?
You will be sent a form under Section 172 RTA 1988. This requires you to name the driver at the time. Failure to comply in 28 days sees a large fine and 3 points .

You then have three choices.

1. Tell them it was you.
2. Lie about who it was not.
3. Do nothing and hope it goes away (which it will not ).

I think perhaps you're asking the wrong question.
Whether or not you were there is immaterial.
It's a question of whether or not they successfully detected your speed that's relevant.

Bugger, what is the chances of them taking any action probably pretty high i would have thought!!! what would the expected panlty be if im a good boy and admit it was me am i going to get away with just a huge fine and one of those 1/2 day driving cources or am i going to get a few points thrown in for good measure?

They will only take action if they were recording your speed. They may not have been doing that at all. You will have to wait and see. The NIP must be sent by them to you within 14 days of the day after the offence. You do not necessarily have to receive it within that time. If after about 1 month of hearing nothing, it would be safe to assume that you were not captured on this occasion.

I should wait and see, deserted motorways are notoriously dangerous, I'm sure we've all seen the headline..

"car pile up on deserted motorway at night"

We're just lucky trafpol weren't wasting their time looking out for people racing rond blind corners or in town centres.

Another crime where the only victim is you.

Indeed, if you want to drive like that you maniac, do it it heavy traffic where your are less likely to be seen.

Sounds like they were waiting for someone/something to me. Otherwise they'd have probably pulled you at such a late hour to see if you'd been drinking/doing drugs. Cops rarely sit and do nothing unless it's doughnut time, but then I think they'd pull off the motorway.

Unless you saw them with a hairdryer and a notepad I'd not be too bothered (famous last words).

Under 90 mph you are fine. Over 90, but under 100 doubtful.

You might be in bother if it was quiet and the coppers are feeling keen.

The Association of Chief Police Officer guidelines are 3 points up to 96 mph, and court above that.

Personally, I was on the M25 yesterday, doing 90 mph on the cruise in lane 1. I was being overtaken by someone in a Focus in lane 2, and he was being overtaken by someone in a Peugeot in lane 3.

Of course - you can always tell them the info in such a way that they can't use it in court.......

Really effects the scumera pratnerships mostly as coppers will pull you (unless moonlighting).

so Option 4: Respond to NIP/S172 with a Witness Statement invoking PACE. End of problem..... Ticket fly away.....

Whats PACE?
i have heard roumers that there numberplate recognition doesnt work in the dark is this true?

The BIB do not need to have ANY form of speed detection other than their own eyes (been there, got the points).

If two officers say you were speeding, then there's nothing you can do (unless you can somehow prove otherwise). Personaly I think that this is so widely open to mistakes and abuse that any "speeding" should require some kind of independant evidence from VASCAR etc.

I had an interesting sort-of encounter on Friday:

On way home Friday afternoon, get to big r-bout at junction of 2 dual carriageways, see a police helo hovering at no more than 100ft, facing my way. I'm at traffic lights waiting, he faces me for 30sec, then turns and heads north-ish. I don't think any more of it, turn north up the d-carr'way, nail it, hit 80+ briefly, then look and the damn helo is keeping station with me at my 10-o'clock, just out of sight of the top of the windshield.

Any thoughts? Not sure whether to be paranoid or not (if you see what I mean).
