Speed Camera Tolerance

What is the tolerance of a speed camera before it takes a picture? Have just passed a camera (a on coming camera which flashes in your eyes, nice and safe! and photographs the front of your car) at 44/45mph on a 40mph road. This seems a low margin of speeding to get 3 points for. Anyone got any thoughts? Do cameras ever just go off without actually issuing pictures?
I's 10% plus one, so:
23 in a 20
34 in a 30
45 in a 40
56 in a 50
67 in a 60
78 in a 70
...won't trigger a GATSO, but I wouldn't bet against a truvelo or a mobile unit snapping you, plus if the Police literally catch you in the act (patrol car keeping up) you're toast.
TBH I don't think these tolerances are too bad, but my problem is pointless lowering of speed limits (long-standing 60s to 50s/50s to 40s/40s to 30s, with barely any signposting).

The camera flashed twice as I passed. (I was looking straight into it when it gave off a nice second blinding flash). It was on the opposite side of the road, which would make me think that it was photographing the traffic in the opposite direction, expect there was no one else there. There were no markings on the road or camera warning signs in the direction I was traveling, though there were in the opposite direction. So annoying. This is a straight 1 mile road which as you say goes from 40 to 50 and back to 40. Guess time will tell.

If it was a Gatso then you'll be in the clear - AIUI road markings are needed as part of the photographic evidence. Markings on the other side probably means the camera was only set for rear detection on that side of the road.
If it was Truvelo then you should have seen three narrow bands on the road immediately in front of the camera. Unlikely though - Truvelo units tend to be forward facing and kerbside to the oncoming traffic.

10% + 2, but only a guideline that they seem to ignore now.
Gatso near me has done two I know at 32, Truvelo at 34.
If anybody has proof of safety camera partnerships prosecuting at less than ACPO guidelines then Paul Smith will always be interested.
Most partnerships have their trigger levels set above the ACPO guidelines, but some (Hampshire in particular) operate at the +10% +2mph, although they like to keep quiet about that.

You may have been flashed by a Gatso!! (But how..?? I was going towards it!!??)
Its a shame we can't tell which ones, but not all the Gatso's are the real deal. On the dummies, they put cheaper workings in there. Enough to make us think we've been done but it doesn't monitor the section of road its meant to be pointing at properly hence you get done way off in the other lane. It won't detect the speed properly either, hence the low speed flash.
I've been snapped loads of times in this way. Cruel but many's a poor sod in the lane thats meant to be monitored doing 39 in a 40 has been snapped by me coming towards him at 50
