Learned ones.. is a gentleman's word his bond? The shower that was 'fixed' by our vendor gave up the other day. He was asked to address 2 things before we move in last Oct.. some damage to an internal wall, and the shower. The wall was done, so I assumed the shower fixed, obviously just bodged. Do I have a formal comeback? It was a verbal request (not in writing) given by myself to the estate agent. The message obviously got through louad & clear as the wall was fixed (unless the hole healed itself / DIY thieves broke in..)

The trouble with a verbal agreement or verbal contract is that it isn't worth the paper it's not written on.

It's only worth it if the bloke is a gentleman in the first place. if your shower hasn't been fixed, he isnt is he

A verbal contract has exactly the same force of law as a written one. Just more difficult to prove/enforce.

Hence the phrase 'Isn't worth the paper it's written on'

Sorry you almost certainly don't have any redress if his conveyancer was any good there will have been a clause in the contract excluding any representations made about the state, condition, etc, of the property save as contained, or referred to, in correspondance between the conveyancers.

Note to all PH'ers - if you agree anything like this with a house seller tell your converyancer. Unless you are going for the bargin bucket factory they will happily add a para in a letter to the seller's conveyancer asking them to confirm that the shower will be in good working order at the date of completion and that the damage to the dining room wall will be repaired.

Edited to add that it is quite right that he may have fixed it and it just broke again.

I agree with you Greg, I have met some very honest and generous gentleman some of them single....

or am I missing something. I can't quite see the point of moaning about it to us. Either ring him up or fix it yourself

Indeed, although my attempt at dry wit by saying "isn't worth the paper it's not written on" obviously went unnoticed (or more likely simply wasn't funny).

Seems to hit the nail on the head - it was working when you bought it - what responsibility does he have for a shower that _you_ broke ? [when you look at it from the other side...]

The point is I'm not convinced he did fix it. Im after advice not moaning at you.

You bought it, unless it was a new home, or there was a specific clause in the contract which I doubt, your problem........caviat emptor

You're unlikely to get anywhere with this complaint, Ed, unless you told your conveyancer that these two repairs were part of the deal and it was added on as a 'special condition' on the contract.

As for whether there's any gentlemen left in the world - in my experience, there are few - but not many.
