I purchased a lawn mower april 2014. I am now having problems with it starting. Have spoken to the company who have talked me through various things on the phone to rectify problem but to no avail. I had a lawn mower tech pop over the weekend and he looked at it for 20 mins and couldnt work out why it wasnt working. I paid for it on visa. What are my rights?

How much was the mower? How many times have you used it?

Silly question perhaps given you paid by card, but I assume brand new as well?

Two routes here:

Sale of Goods Act against the seller. Note, this is separate to a guarantee or warranty.

Consumer Credit Act against the credit card company.

However, in both cases it would hamper your claim if you did not know what the problem is. The case that you must prove is that on the balance of probabilities the fault (either in terms of a non-durable part, or design fault) was there at the time of purchase.

Not knowing what the issue is makes this difficult to prove.
