When driving south on the A90 on Friday afternoon I clocked a speed camera van sitting at the side of the A90 just before the Forfar turn off in the entrance to a field

now correct me if I'm wrong but isn't that speed camera van illegally parked therefore can not be used to prosecute speeding drivers ?

as per highway code regulation 270

You MUST NOT stop on the carriageway, hard shoulder, slip road, central reservation or verge except in an emergency, or when told to do so by the police, HA traffic officers in uniform, an emergency sign or by flashing red light signals. Do not stop on the hard shoulder to either make or receive mobile phone calls.

You're wrong.

Consider yourself corrected.

Well, for one thing why would you assume that the illegality of their parking renders the evidence they gather inadmissible?

Looks like the HC rule you've quoted applies to Motorways. The road in the Streetview link is not a Motorway.

as per highway regulation 270 as I stated in my first post.

for example a camera van was spotted parked in Aberdeen on side street sitting on double yellows which rendered all evidence collected that day as inadmissible

and reported in the local paper the 40+ plus drivers they caught that day would not be receiving NIP's

Can only take your word for that really, have you got a link? I've only heard of tickets being cancelled en masse when there's been some kind of procedural issue.

Broadly speaking my understanding is that they can park where they like in the course of carrying out Police business. So long as it's not actually dangerous rather than simply illegal I can't see what difference it makes really?

so for instance if Mr Farmer decided to turn up trundling along the carriage way and wanted access to his field he would have to stop & wait on the carriage way until the camera van shifted, or does Mr Police camera van man phone the farmer before hand and say he we are using your A90 field entrance today so don't bother using it between 0-clock & 0-clock

Presumably the camera van driver was using the parking exemption of... "or when told to do so by the police" smile

that's open to interpretation from the Law

if you are driving your vehicle and mr police indicates to pull you over then you stop at the nearest safest place

whats mr camera mans emergency or who told him to stop there ?

Emergency service vehicles are exempt from most parking regulations and certain aspects of the road traffic act.

what part of emergency does a camera van take part in ?

infact I'm pretty certain the camera van doesn't even sport a blue light but an orange one instead

It's an emergency service vehicle being used to undertake policing purposes so is therefore exempt from parking restrictions.

It doesn't need to have blue lights etc.

I could legally park my own private vehicle there if it was being used for a policing purpose.

so would you dial 999 and ask for a speed camera van to be sent round double quick EH I don't think so

No but that's not the point. The fact is this vehicle is undertaking work for a police purpose (speed enforcement) so can legally use emergency service exemptions in relation to parking and the road traffic act.
