Hi all,
just wondering if anyone can offer any advice on what to do in this situation...

My elderly mother bought a manual roller lawn mower online using her credit card.... how she managed it I have no idea as she usually seriously struggles with anything online!

Anyway the mower arrived on Friday and I got a call to ask if I could go over and assemble it and test it on her lawn.
So on Sunday I got time and went over and assembled it.... now the problem...
its absolutely st...doesnt even cut the grass, possibkly the worst rubbish that I have ever seen. I tried it in every single different level of adjustment with no change.
She bought it after speaking to my father inlaw who has a manual roller mower... his was half the price she paid and actually does what it is designed to do!

So I dismantled it and repacked it in the box and emailed the webshop on Sunday night requesting a returns address.

The reply I recieved states that they have reported it to the manufacturer and will be in touch when the have discussed it with the manufacturer as it was delivered direct from them.
Now as far as I am aware my mother bought from the webshop, not their supplier and should be returning it for a refund from them??

All that jazz

The "webshop" could be a dropshipper, in which case they don't have anywhere for you to send it back to and you would have to send it back to the manufacturer.

Credit Card issuer will assist also with regards to fit for purpose, returning issue etc.

Keep all e-mails you send etc as this will help with your case if it gets to a charge back situation.

I have no problem paying the return postage, but at the moment the webshop doesnt appear to be considering a refund.
My mother called Barlclaycard they said they would do a refund, but they may ask for a written report on the mower!?!? which would cost more than the bloody mower! - never heard such a load of cobblers from barclaycard and might make a complaint about that if that proves to be exactly what they said to her.

This.

Although technically the Distance Selling Regulations don't exist any more, being replaced in 2013 by the Consumer Contract Regulations.

Basic upshot is that you now have 14 days after receiving the goods instead of 7 to cancel the contract for any reason, although yes you will most likely need to pay return postage.
