Came home today to find Mrs Sirbadger has received a £40 Parking Charge notice from UKPC for:

"Not parked correctly within the marking of the bay or space"

..ignoring the fact that this should probably be in "the bad parking thread", should we appeal or pay up?

The car park in question is a free unticketed (?) car park and apparently it was the only way she could park and get the little one out of the car...

Thanks

ETA: its free for the first 2 hours but you don't need a ticket.

I'd ask for photographic evidence.
If they can provide I'd just pay it.

The Mrs admits she was over the lines so I don't doubt they can supply evidence... Just feels wrong to get a parking ticket in a free car park.

Just make their lives as difficult as possible....

1 - Request photos
2 - Then dispute it along the lines of the non-inconvenience and genuine pre-estimate of loss
3 - Then if refused request a POPLA code (costs them £27iirc and you nothing)
4 - Repeat option 2
5 - Decision, if let off by POPLA, result...if not choice of whether to pay it or throw it all in the bin as their decision isn't binding on you...

Were you parked incorrectly or just disputing a PCN?

Get yourself to pepipoo.com pronto and see what they make of it. Better advice than most other places I think. Don't contact the penalty charge issuer until you have got advice from ppoo.

The car park offers different parking options:

Parking in a single bay is free.

Parking across two bays costs £40.

She was in the wrong so looks like we'll be paying. Lesson learnt... Hopefully smile

So in answer to his question you WERE parked incorrectly.

- you just found a suitable dodge that avoided you having to pay for it.

Although inconsiderate to other car park users, the operator has suffered no loss so until the current Supreme Court decision is made I would refuse to pay on that basis.

Were there no Parent and Child spaces in the car park.

Or were they all taken by transit vans and fat people?

I got a parking ticket for parking my own car in my own space whilst also displaying my permit!

I replied / appealed "Please demonstrate loss incurred by me parking my car in my space whilst displaying the permit, as can be seen in your photo? I'll await court proceedings"

I got a reply asking me to prove my permit was on display at the time of issuing the parking notice.

I've ignored all following correspondence.

Hopefully it'll go to court. Might be able to counter claim?

I wouldn't worry. I'm constantly on at my wife for exactly the same thing.

She says, "Yeah, but they won't make my pay for doing that."... and I respond with "Oh yes they will." smile

If I were you I'd say that cars parked either side meant you parked in the space available. Who's to know when the miscreants left?

NO. I didn't miss it. It just didn't answer the question.

Just for clarification.
Your moral outrage aside - Did you overstay the allotted time allowed for everyone?

A simple Yes or No would be great. biggrin

A moment of weakness, my apologies.

Vans and fat people included here as we are not biased. The crux of the issue is that cars are bigger, doors much thicker and it's difficult for parents, van drivers and fatties to get out of the cars and vans.

If the parking spaces are made for 1960's cars and its nearly impossible to fit then I would not pay. If it's bigger than that then I would.

The amount of times I have had to push my car out of the parking space because of people squeezing in the bay next to us when their 4x4 clearly does not fit is far to often for me to pay any parking charges for the use of an inadequately sized car park.

Got a ticket in the shared free work car park the other day which is monitored and run by some parking management service. Apparently not parked in a marked bay. £100 penalty.

Parked on a section of dirt in the car park which is surrounded by parking spaces - everyone does it as there is not enough parking for everyone in the office.

No where does it say that it wasn't a parking space, nor did it say not to park on it, and at no point did i inconvenience anyone, nor did i afford loss to my employers or the associated business which shares the car park.

I also stated that i believe that the penalty is grossly unjust.

I emailed their appeals process... Waiting on their response back.. Were see where it goes.

Happy to pay a small penalty, but £100 is majorly over the top.

I see now.

You were in the physical space for 119 minutes or less, but in the car park itself for 121minutes or more.

I'm surprised they even bothered sending the invoice - if you truly were only 3 or 4 minutes over the 2hour limit.
