Can anyone tell me where I stand when it comes to someone using video footage with me in it to sell it commercially, but without first seeking written conformation that I am happy to be used?

I'm not sure as to payment, but my understanding of the use of your image/you relies upon if you are you a "celebrity" or someone who considered to be in the public eye. If you are, then the people responsible have no need to ask your permission - hence how so many candid shots of "celebs" topless and the like surface. If you are just an induvidual the you stand a good chance of stopping it.

IIRC you are the Chairman of the Atom Owners Club? I'm wondering if they could hide behind something like that.

Again, this is use of images, not sure if it equates to making a profit from them.

Surely though when you see the likes of these reality shows, sometimes there are people who are blanked out to as to hide their identity, surely this is because they didnt agree to be seen??

My understanding is the same as yours in that members of the public need to give their permission, people considered to be in the public eye/celebrity are free game.

It would help if we knew exactly/roughly what the situation was?

My daughter was photographed whilst we were on holiday at a Well known UK holiday resort, it was professionally done, we knew the cameras were there. At the time we didn't realise the picture had been taken. When the new brochure arrived we saw the picture had been used several times it was also used on posters on-site and it is also on thier website.

We were extememly proud that the company had decided to use our daughter for thier advertisement. However, we realised that we would not be rewarded for this as the T&C state that this could happen and if we didn't want to be photographed to stay away from the cameras.

As mentioned above it would be interesting to see where the footage was taken as you may be bound by Terms and Conditions.

I lent someone a comercial set of cameras, which they then turned into a dvd and are currently selling the footage over the net.

They have neither included me in the "with thanks" section; and as I was in the car, helping do the filming, im in camera shot on regular occasions.

So what you're basically saying is you had a friend, you lent him/her some gear of yours.

You haven't mentioned an agreement so I assume there was no mention at any time from you that if a commercial product were to be created you would want thanks/a cut of proceeds.

You've now fallen out and want some payback - that's basically it isn' it?

Sounds tough 5hit to me - it's one of those things, it's not like you've been shafted with money is it?
