I think since they announced backwards compatibility they got flooded with people inviting their friends to the preview scheme and stopped it. A few friends have tried to add me but I have got nothing.
Apparently the backwards compatibility is restricted to certain titles, so if they aren't included in the scheme you cant play them. I was hoping it would mean you could play the whole 360 game back catalogue but sadly not.

So I have lots of games, but as I bought the physical version I can't play them using BWC. (unless I buy them again)
Things may have changed since they announced it - but my understanding was that you can play the games you have on disc but in order to do so you need to download the digital version of it onto the XBO - which I assume would be free if you already own the hard copy. Its not going to be all games though - just the ones that the developers allow.
I'm a preview member, and thats certainly how it is at the moment.. The Xbox ones disc reader cant read 360 discs (different technology), so there's no way they can know what you have.
The only way would be to use what you have achievements in, but that's not a reliable method of knowing ownership.

Not so - I had an old copy of Borderlands that I have never played - popped it in the XB1 and it recognised the disc and prompted the install of the download. Same for Viva Pinata I borrowed of a friend.The only way would be to use what you have achievements in, but that's not a reliable method of knowing ownership.
