Notice Periods

Hi All

My current contract stipulates that I must give 3 months notice to leave which I am considering doing and am more than happy to give. Once I resign, is it possible for the employer to force me to leave earlier and not pay me for 3 months notice?..

Only if you are dismissed, for gross misconduct for example. Can shorten it my mutual agreement.

Many employment contracts contain what is called a PILON clause. This allows the employer to terminate the contract early by paying the equivalent of the salary for the notice period. Also, the contract may permit the employer to place the employee on garden leave - this keeps the contract in being, but the employee is not expected to work. He or she should be paid (in most instances), but cannot work for another employer until the notice period has run its course.
