Been working as a contractor at a company for close to 3 years, there is no formal contract in place, all done on a handshake. The place has become pretty toxic to work at due to office politics and a particular director making unreasonable demands in terms of hours working (frequently having to work on weekends to catch up with things thrown at the department, haven't managed to take any leave in close to 2 years as the workload is unrelenting). As there is no formal contract in place what are my options for leaving? I have a feeling it will come to a head in the next week as pretty much I won't keep agreeing to the workload and will resign. I have some money to tide me over for a couple of months, hopefully enough time to get another job so if I want to leave, my options??

On another front, my colleague is in same boat but employed directly. His notice period is 4 weeks (he's been there 1 year, 3 weeks). He has 7 days holiday entitlement, what are his options as he is lining up another role at a non competitive business?

Unfortunately, having to pose a question such as this highlights the importance of having clear terms and conditions from the outset.

In answer to your query; if you have nothing written down, I'd do the right thing, and having been there for that long, I would give a minimum of a month's notice. Keeping things cordial is always important.

I am always amazed that people can place themselves in these situations. Two years without a holiday... just bonkers, and bad for you.

effectively having been there so long, your contract is likely to be implied from similar level permies.

So a four week notice period seems a fair period of time to give.

How are you operating as a contractor? Are you billing via your own Ltd Co?

If you are a contractor (sounds to me like you are an employee) then it will depend on what your contract says. If there is no contract then there's no obligation on your part to provide a notice period.
