Private parking charge after car sold...
Discussion

What does the law say about this? The parking was a few days after the car was sold. I do have the details of the new keeper, but do I have any legal obligation to respond to the private parking charge notice as I wasn't the RK when the parking contract was allegedly breached?
Bert
Assuming you sent the V5C off sharpish, it depends.Bert
You can reply with a quick note saying "Sorry, sold the car on <date> to <name/address>, who should now be the RK."
Or you can wait until it all gets seriously time-consuming to deal with just to try to prove some shallow point.

Option 1 certainly seems the most sensible route, but....You can reply with a quick note saying "Sorry, sold the car on <date> to <name/address>, who should now be the RK."

Given that this is Pistonheads, surely following option 2 and proving a point, in the most difficult and time consuming way possible, is the only sensible way the OP should progress

Read the whole of that message, and you might find out.
So are you saying that the RK obligations don't cease at point of sale, that the RK change takes place when DVLA get the V5?If so can you refer me to where that is defined please? I would prefer to believe that the RK changes on signing of the V5 by the old and new keepers.
Thanks
Bert

Sometimes I think people talk in riddles because they don't have a real clue about what they're trying to say.
So you have clearly and very adequately proven how SP&L is a bit of a s
t place.
Just a simple question has to have a smart-arse t
tty answer. Why?

Clear enough, I thought.

Perhaps because it's a bloody silly question...?
Why wouldn't anybody sane just reply to the letter with "Sorry, not me - sold it a few days before."? By all means get on your high horse, but all that's going to happen is you're going to get more ball-ache further down the line.
Think about it for a minute. The parking company have seen a car parked where it shouldn't be. They ask Swansea who the RK is, but Swansea haven't processed the V5C you sent back by that time, so the RK still shows as... You. Oh, what a surprise. So the parking company write to you. You don't reply. So what are they going to do? Here's a clue... They aren't going to go back to Swansea to check again, just in case - they're going to assume that you're some smart-arse who's getting all pepipoo on 'em. 9 unanswered letters out of 10, they'd be right, too.
Now look again at your reply...

Here's a clue. Until DVLA process the V5C, how are you expecting your RK obligations to cease? They're often accused of being many things, some of 'em even accurate, but psychic isn't one of 'em.If so can you refer me to where that is defined please? The keeper changes when the document is signed, but the REGISTERED keeper only changes when the change of keeper is REGISTERED by DVLA If so can you refer me to where that is defined please? I would prefer to believe that the RK changes on signing of the V5 by the old and new keepers.

FFS indeed. Having decide to research the statute, the relevant part would seem to be mostly written against the keeper rather than the RK.So not as blindingly obvious as you thought. Sad you got on your high horse without actually knowing the answer.
And yes if I prefer not to do what the notice said and use two envelopes and two stamps on the basis that I don't actually need to then, that's my decision. If I decide to send back info and send the form on to the new keeper that is my decision too. Neither need your derisive comments.
It was quite interesting to actually find out some information about how the statute is formed. So that looks to be the best route in future rather than having to engage in facile discussions with morons on here.
But thanks again for your "help".
Bert
Its a lot easier now when you sell a car.Go online and google "I sold my car" and look down the first page for Tell DVLA you've sold or bought a vehicle - GOV.UK
You fill in the V5 document number, the seller and the buyers details and also give both E-mail addresses. As soon as you have completed the form and sent it to the DVLA the seller will get an E-mail saying they are no longer the owner of the vehicle,a letter in a few days confirming you are not the owner of the vehicle and a refund of your car tax.The new buyer will get an E-mail saying that he is the new owner of the vehicle and a new V5 in the post a few days later.
As the seller and buyer will have an E-mail with exactly the same time that they sold and bought the car there will be no issues regarding speeding, parking tickets etc.
So in this case above the DLVA would have give the parking ticket company the new owners details.
