Young Nephew travels back to Cambridge every Weekend using the M3. He recieved a NIP for 57mph on a temporary 50mph roadwork area (Basingstoke) at 22.34 on a Sunday night a couple of weeks ago. This NIP offered the SAC and he has only just sent off the reply requesting the course. Yesterday he received another NIP for exactly the same place, but one week later. This time his speed is 58mph at 22.35hr, once again on a Sunday evening.

He has asked me if he will still be able to attend SAC and then receive 3 points and fine for the second notice but I have no idea. Any advice on probable outcome and how he should proceed?

I think he will get the SAC for the first offence and will get 3 points and the fine for the second. They are totally separate offences.

He should also have learned since the first incident that he was hovering a bit too high above the limit or had his cruise set too high which clearly he hasn't.

Yes he still can attend his SAC but would recommend he goes online and books it for ASAP.You need to tell him that although a hat-trick is good with football its not a good idea with NIPs.

Edited to say I cannot fault his consistency.

He doesn't take hints, does he?

In fairness, 40 miles of nothing more than cones to be "protected" by a 50mph limit for absolutely no good reason does seem a bit of a liberty. Doubly so when it's that time on a Sunday.

I'd assumed that he'd committed both offences before he'd received the first NIP. He's not that silly surely!

40 miles at 50mph takes 33 mins.
40 miles at 58mph takes 38 mins.

I hope he used that five minutes well.

I think your calculatons are a little off.

40 miles @ 50mph = 48mins
40 miles @ 58mph = ~41mins

So about 7mins quicker, but either way a lot worse off financially...

Hopefully no more to come but not ruling it outrolleyes He received the first NIP after he had completed the journey again, so was unaware at the time he had done it again. I think he had his cruise set a little fast, hence the 1mph difference. Still have to hand it to him for consistency, 1mph and 1 minute difference 1 week laterbiggrin

He has posted the first NIP off does he now have to wait for a reply before he can book his SAC?

As your nephew's concern has been addressed please forgive the hijack smile

Every time I go through temporary work anywhere at all on the motorway network protected by a 50mph average speed check I set my cruise to 54 and get passed by lots of other people

I even started to wonder if they were ever live or just dummies

Cheers

Well it is very rare to see the invisible workers, one per 5miles is about normal in most roadworks.

The road surface they are working on needs protecting, they also need their own work live lanes to travel on with heavy machinery. If someone clips a cone at 70/80mph it would cause a lot more damage than someone clipping one at 40/50. It's about your safety too as well as the workers. If you travel along this stretch of the M3 you will know how narrow the lanes are. I personally wouldn't want to pass an HGV at 70+ on such narrow lanes.

Try working on the motorway for a living with vehicles passing 70mph+ then come back and moan at the 50mph temp speed limit.

My neighbours brother in law had a couple of days work over a bank holiday weekend which meant he had to use the M6 over thelwall viaduct when the 50mph was on

Luckily it was only 2 days because he got caught speeding sat and sun , he already had 3 points so if it'd been a 3 day job he'd be banned

Why does it take months/years of endless lane closures and temporary speed limits with workmen that you never see in this country to do what the so called "lazy Americans" can do at nights and outside of rush hour in often a week or two without so many lane closures too?

He should confirm he drove that fast all week and that it's just a continuation of one offence.

I pass through these M3 roadworks regularly and it is interesting that when leaving the works sites near the end of the limit, but before the last camera, that those same road workers leave at well over the 50mph limit. It appears they do not have the same regard for those working on the motorway as they would like the rest of us to have.

Of course you're right in principle but the roadworks on motorways are very poorly managed and it is generally accepted that the road closures/ restrictions are very often unnecessarily long. You will be aware that it's currently under discussion by government.

Bad management and unnecessary restrictions are bound to engender disrespect and lead to people questioning them. Doesn't bother me too much; as said, stick the cruise on 54/55 and be patient, but it doesn't make it right.
