Hi,

Before I go any further, I was in the wrong, I'll pay up as it's easier, but I do think that the fella was an utter tw@t and he could have used discretion, And the missus thinks I should appeal biggrin

Went to Bourton-on-the-Water today, generally go 3 or 4 times a year. Usually in the M, and have a favourite parking spot. In a large car park, at the very end, there is a space in a corner that is the last one, which next to it is just a square piece of "wasteland".

We arrived today, paid for ticket and backed into space. Another car came along while we were getting out and parked next to us - they opened the door, and I realised they were an old couple (90's I would say) and they were trying to open the door without hitting mine. I said, Hold on, i'll move over to make it easier, and went over the line into the "wasteground" about 2" or so I suppose, but have done it many times in my other car and wasn't worried. They thanked us, had a bit of a natter and we all went on our way.

Came back 4 hours later and walked to our car - saw the parking fella just up the way in a heated discussion with another couple, thought nothing of it and went to our car, Saw the ticket and thought "ah crap, didn't think we'd stayed over" read it and it said we were outside the white lines. I suppose we were.

As I'm now a much more relaxed chap after anger management, I just said "oh well, never mind", but the missus went spare, saying that £50 quid was rough as we hadn't even gone into another parking space. I said I'd have a word, but as he's wrote the ticket guess it wouldn't do anything.

I was right, the guy was a tool, he was however getting some abuse from a couple who were "solicitors" who were going straight to the police due to their ticket, and were telling him things like " bet you love your job!" and "Suppose you live with your mother" and "Police force didn't want you then" hehe

After he finished his spat with them, and telling them it was illegal to take a pic of him etc, he called his boss to say he was being attacked (I presume verbally) and where he was and that there was another one waiting to "have a go" (that was me!?!?!) I just asked couldn't he have used discretion as I was not impeding any spaces, was helping someone out when I parked up, just thought it was a bit rough. "It's the law mate, I hold up the law and you broke it!" fair enough say I , but surely what I had done has just made it easier and he could have left me alone for that one, 50 quid a bit harsh etc. "It's the law, you cannot argue with the law, I am following the law to the letter." Yes, I know, but c'mon *shrugs* a little leniency maybe? "Look, it's the law, I am following the rule book to the letter, if you did it wouldn't have come to a fine would it?!" Fair enough, I'll pay it then, just think you could have been used discretion as the police do in such matters, start to turn away. "Look, I can see where you are coming from, you haven't parked bad, and I would also be unhappy to get ticketed for that, but I am following my job to the letter"

I just walked back to the car showing the wife a sneaky cocktail shaker sign on the way back (which got laughs from some onlookers. As we drove off, he was leaving tickets on 2 motorbikes using parking spaces.

Now, I would just pay, but he did piss me off, especially when he said he would not be happy about it. I just want to check that everyone else would too. (in case anger management has made me too soft rofl )

Have a pic if needed. Happily pay, but just want to make sure.

Cheers

I think whoever oversees the council parking appeals usually shows some common sense - I know a load of people get let off in our area where the Adjudicator said the way they'd been caught was sneaky.

I met the same guy outside Stansted airport at 4am the other day. Words can't describe what I an idiot he was. He was so proud he booked my mate for stopping on his private land. According to him he owned all the land up to the M11 and all the land around Heathrow and it was illegal to stop anywhere.

Anyway, do some digging around the net and I'm sure you'll find a way to get away with not paying the ticket. I was booked over a year ago for parking in a dominos pizza car park while I waited for my pizza. The staff said the car park was free. They failed to mention it was only free for 10 minutes. I was fined £100 for staying 14 minutes. I found a template for a letter on the MSE forums to contest the fine. Letter sent off, didn't even get a reply. Some people say throw the ticket and letters in the bin but I think that may end in tears.

Good luck!

He told me I can appeal "by all means, but I am working to the letter of the law! it would be a waste of time, and my manager knows I have been abused" blah blah .

If we appeal, it will go over the 14 days and we have pay double - is pretty much what we gather.

So probably best to pay it.

Thanks

As it's a council ticket, the reduce fee is normally applied until the result of the first appeal. If that is rejected and you decide to take it further and lose, you'll pay the full ticket amount.

No point arguing with them, just follow the fine example set by Plank, Dog et al...

I got a parking ticket once, I wrote to the the council to say that all of the on-road parking tickets in the borough were invalid because the signage wasn't complaint with the Traffic Signs Manual, funnily enough they didn't pursue me it any further. laugh

I'd appeal it. No increase in the penalty while they consider it. Just tell them why you did it. Don't mention the attendant. Any half decent authority will rescind it. (they'll also keep a note of your details so you can't make a habit of it)

I agree. Pisses me off to see someone punished for showing consideration for others. Meanwhile lane hogs and other thoughtless/selfish bds never seem to be done.

Unfortunately, those days are over; adjudicators now take the view that as long as the signage vaguely conveys the meaning then that's satisfactory. Close enough is good enough.

It's a pity that "close enough is good enough" doesn't apply to the punters though e.g. two inches over the parking bay marking.

It may vary depending on the council, but when I've appealed to my LA the clock on the 'discount' period stopped when I appealed.
