My dad had a collision with a car two weeks ago. He was on his scooter (moped). Turns out he has fractured some vertebrae and spent over a week in hospital, and now been allowed home with a special back brace fitted. It could go 50-50 or whatever I don't know, I don't think it is 100% clear cut (& no witnesses of the accident)

I found out tonight he has spent over an hour on the phone today with carpenters 'solicitors' claims management company and agreed to let them chase his claim, given them all details etc of everything. Swinton brokers had 'helpfully' let them know about his accident. I questioned him & so far he has not signed anything, and has not given them any credit or debit card info. He does not need a hire bike (as cannot ride at the moment) so told them straight up that was a no-go when they tried to arrange that.

So, he still wants someone to manage the claim for him as he isn't up to it. I know they have a bad rep but bearing in mind he wants to use one, I would like him to use europa http://www.europaconsultants.co.uk/ (as they have had good reports on here, and member anniesdad works for them / runs them).

So my question is, can he back out of his agreement he made over the phone with the first company, in order to use (in my opinion a better) company?

A lot of insurers have contracts with accident management companies to take on all the post accident work.

At the end of the day you can go with anyone you decide

BV will be along shortly to explain why the previous poster is wrong in English law.
If all the elements necessary to form a contract are in place then it will stand.

Was your Dad warned that his call may be recorded? If so, that might prove problematic.
Hopefuly he will be able to withdraw without any financial consequences but don't bet the farm on it.

Most of the bad reviews are two or more years old.
However that part of the country seems to have more than its fair share of below par practices.

I had something similar a little while ago.

Spoke to a claims management company, gave them all the details and said I was happy for them to deal with it.

Got the paperwork in the email, I didn't like the wording and just told them I had changed my mind. End of case.
