I've just had a small accident recently. No need for details, but its technically my fault, and my insurance co says so.

Question is how does the other party's excess get paid? Does his insurance company (Norwich Union) pay his excess back to him?

I have been receiving letters from the other party demanding I pay his excess, the last of which is a threat to take it to County Court.

The other party has to claim it through his insurance company. His company will then chase your insurance company. It is absolutely NOTHING to do with you personally. If you are unhappy with the idea of just binning his letters, simply forward them to your insurance company.

As above. If he is hassling you though, tell his insurance company and they should contact him to tell him nicely to stop being a prat.

If it came to arguing fault and anyone does get summons to court, it would be the other persons insurance who summon your insurance, via you though, so you would get the summons yourself, which your insurance then deal with.

His insurer will generally not be interested in recovering his xs and if he doesnt have any kind of legal expenses cover it would explain why he is hasseling you himself.

It could well be that your insurers despite having confirmed to you they are not disputing liability are ignoring his requests for payment and he is therefore forced into coming to you. The name you mention is one that we do have problems making third party recoveries from.

My advice would be to contact your insurer and explain that you are rather pissed at getting letters from the T.P and would they kindly DEAL WITH HIS CLAIM!

Thanks. I thought I was right in my understanding of the process. I rang him, ( I realise I shouldn't), to tell him to go to his insurance and get them to sort it out. He hadn't contacted them so far.

His policy doesn't have legal cover, so he thinks he needs to get his excess back himself. Surely this is not what legal cover is for. It's just his insurance company being slow.

I have been forwarding his letters on to my insurance, as instructed.

If he doesnt have legal expenses he is correct in thinking he has to recover it himself. The legal expenses cover is for the recover of uninsured losses such as personal injury, loss of earnings, hire car charges and of course xs's.
