When you call certain companies they will say at the start of the call that 'this call will be recorded for training purposes' etc.

If a company wants to record your call are they obliged to say that or can they just record away at their leisure?

As they all seem to say this, I had assumed it's a legal requirement to disclose beforehand....

Yup. You legally have to tell someone if the call is being recorded.

It's interesting how often, after returning the call is being recorded favour, that people don't want to talk to you.

NTL do this a lot - they are big on verbal contracts.

You complain and say it goes against your contract. All you have to say (to a super) is 'get the tape out then' and they crumble.

I like it

hmmm, interesting.

I've been told otherwise.

Basically I was cold called a an internet business directory type company.

I just (foolishly) answered yes to all the questions and later recieved an invoice for a listing on their site.

They have sent me lots of letters and I have sent them letters saying I have no knowledge of the call.

Anyway, the company have called me today saying that they are sending the matter to their solictitors for collection and they then played me a tape of the conversation.

At no point was it made known to me that I was being recorded and when I mentioned this to the person they said that it was no longer neccesary.

I used it against a dealership when they refused to give back my refundable deposit.

Worked a treat!

The legislation (for the legal eagles amongst us)

Hit the nail on the head.... point 44
"In all of these cases, the Regulations require businesses to "make all reasonable efforts" to inform those people who use
the organisation's telecoms systems that interceptions may take place."

Most companies use small print on letters, waffle on the radio ads or an IVR on the phone system...
But its as long as they make the effort thats it...
