Bugger just received a letter today saying i was cought on camera doing 36 in a 30 zone. fair enough i'm obviously guilty so fair enough. i was driving , it was my mistake and will take the punishment etc. I'm not bleating about it at all it my first ever. One thing that is of concern is that they said they wrote to me on the 27th of november to notify me and that this is a final notice. Now if i had received the first notice i would have responded straight away. I have had issues with the post office delivering to a similar address before with the same postcode and i have had mail for the other address too. thing is where i have bobbed the mail round to the care home they have sent mail back saying not at this address. I have filled the form in and sent it back straight away with a letter explaining what has been happening with my post and with sincere apologies for the delay in responding. does anyone know if i will be able to still take the driver awareness course and save having points on my clean for over 25 years licence ? there was also mention of 1000 pounds fine and 6 points for not responding but this may be waved if i send this back within 7 days. it was posted back 2 hours after receipt of the letter today. As i say , i take responsibility i was over the limit and will accept that, Its the failure to respond to a letter i did not receive that is bothering me as this was out of my hands. can i ask the fine folk here what they think the possible outcome will be. ?

Christ man, calm down. You've done more than you needed to do. Fill in the form, send it back. They'll write to you offering you the chance to spend an afternoon being patronised by a homosexual in a cheap suit (experiences may vary) and finding out that we share the roads with people who genuinely couldn't tell you the meaning of any of the road signs in the UK.

Do not worry you have responded now so everything will be ok.As it is your first time speeding you can do the awareness course and the 6 points and £1000 fine is if someone does not name the driver responsible for the speeding the RK could get this punishment at court for non notification.

I will make no difference but you could have rang the number and spoken to someone to admit you were the driver, that you did not receive the first letter and that you would like to do an speed awareness course. Then you would not have had to send the letter you received back and they would have E-mailed you information on booking the course.

Cheers for the replies guys. i am not panicking was more just a tad concerned that my first notification was a final notice and the 6 points etc was of concern. I did try to call the number on the letter this morning but i wasn't getting any answers. I thought best to write an additional letter and send it back. I will await the response and just see what happens in due course. As i said i have never had one of these before so will wait and see what happens now and will prepare for a days lecture telling me what a bad person i am for slightly speeding . cheers guys .

You weren't 'slightly speeding', 36 in a 30 is 20% over.

Also it will be 4 hours for the SAC and try to go there with an open mind.
My experience of it was very positive.

The instructor has to try and educate attendees who's knowledge of speed limits, signing, stopping distances etc. is limited to say the least.

I take that on board and as i said i am more than willing to attend the course. but in 25 years of motoring my licence has been totally clean and never had an issue. as i also said i put my hands up , i was driving and responsible for my actions and will take what ever comes my way due to it. it was late and on an empty road but accept i should have paid more attention to the speed i was doing as i will certainly do in future.

Has anyone ever been caught in the history of PH at anything other than the just over the minimum speed for prosecution?

Has anyone on PH ever received a speeding fine the first time it was sent out?

well all i can say in all honesty is yes this morning was my first and i can also say i admit all responsibility and had i recieved notice sooner i would have responded as i did today. 36 to me being a layman in law did seem slightly to me albeit i was wrong, but i stand corrected at the 20 percent over. im a big boy and will take and accept as ive said whatever happens. I do thank the folk who replied. its a case of lets see what happens now. to be honest 25 years with no issues in this day and age does not seem to be to be a bad record so far, not had so much as a slight prang or anything else .

I have. Being pulled at 122mph on the M40 a few years back resulted in a stiff talking to. I passed the attitude test & was sent on my way with NFA.

88 in a 50 and I refused to name the driver in the format they wanted. CPS took me to court for both charges, I successfully argued that since both charges were mutually exclusive they couldn't then prosecute me for either without a serious breach of their professional standards, the CPS withdrew the charges, I reinstated them (that is possible), they offered no evidence, and I was found not guilty.

-edit-

Here's all the custard I can muster.

Yup 75 in a 60. Was patting myself on the back at avoiding the suicidal badger and drove through a fixed speed camera I had been passing for the last 25 years!

I am sure I got the first one sent out too. Arrived 10 days after the event. Remember the event well as the road lit up so much I thought the camera exploded at seeing someone go past so fast in a 1.2 clio.

And I raise you with 44 in a 30 in 2005, received notice about 5 days later, didn't post on here saying I was hard done by and how could I avoid on a technicality etc, paid £60 fine as it was then with 3 points.

Got stopped again doing 37 in a 30 only a few weeks before points were due to expire. I was breathalysed, wished a good night, and told to "drive home a bit slower sir"

I didn't ask them why they weren't out catching real criminals, or tell them I pay their wages.

72 in a 40 on the A406 about 10 years ago. Hooned it away from the lights, they were two cars back, get to a straight section and the blues come on. Pulled over, got out, shrugged my shoulders and put my hands up, knew I was bang to rights. BiB were pleasant and chatty, more interested in the car (a heavily modded Supra), did the usual checks then said "you're a very lucky boy" and went on their way.

I had another experience six months ago. I won't say what happened but the BiB were polite, more helpful that I had a right to expect and again my licence remained clean.

Cameras are a different matter but my experience is with a stop, being polite and honest will go a long way.

I'm not a habitual speeder btw.

Great, except for the fact that his deeds referred to in the link are history (they took place over 8 years ago). The EHCR decision in O'Halloran and Francis was handed down shortly afterwards and blew that defence out of the water - http://www.bailii.org/eu/cases/ECHR/2007/544.html

Technically speaking it might still work (just ignore the NIP and hope they charge for both offences - some police areas still do that by all accounts) but with S.172 being 6 points these days and without the CPS-baiting possibly compliant NIP response it's a bloody risky strategy.

Of course, what they didn't tell you is that they pulled the 72 mph "reading " out of their ar$e - there is no way for a following police car to get an accurate reading of your speed without either following at a constant gap or using vascar over a reasonable distance.

From your description, both of these seem highly unlikely and the fact that they "let you off " makes it almost a certainty IMO. wink

The dissenting opinions of two of the judges at the end of the linked document makes for VERY interesting reading.

That defense may have been blown out of the water by The ECHR decision, at that time at any rate, but I don't think it has been mortally wounded.

Happy New Year, btw
