36 in a 30 - worth fighting??
Discussion
I got flashed by a fixed camera last week in a 30 zone in Leeds and fair enough I was breaking the limit, however, if there had been more than 1 speed limit sign within 500 yds of the scamera I might have had prior warning.
Is it worth me fighting this in court with 3 points already or am I on a loser?
Help please!!!

Hiya Dave...
I presume you mean there was only 1 speed limit sign as you entered the 30mph zone? If so, that's all it needs, in addition to street lighting...so fighting it will be pointless, if that's all there is to go on...
36 in a 30 is mighty low..and it's a shame....
Hope that's only 3 points you'll get (ie: it's not added to some already on licence)
Thanks Streetcop,
I figured I was onto a loser, it's bloody infuriating when a simple error of judgement lands you half way to 12 points and a ban.
I've already got 3 point from an 82mph on a motorway.
I've often heard about streetlights being an indicator of speed limits - is there any truth in this.
By the way, I was out last night with my wife and 5 other police Inspectors and even though I had their sympathy, they had a good laugh!
Thanks

Yep - highway code says that if the street lights are less than xxx yards apart, and there are no repeater poles for the speed limit, it's a 30. Can't remember the distance off the top of my head, think it's 100yards.
i think 188.33 meters apart max off the top of my head.
I suppose it depends if the street lamps are the required distance apart, and if the Gatso was delivering the correctly timed flashes to determine the speed caught on the film.
I reckon at the least you'd want to check for the correct calibration, operation and look at the proof to see if it stands up. You might want to research how to time the flashes to verify the accuracy yourself - a simple (rough) way is to video it flashing and count the frames. You get a 20ms accuracy this way - or _exactly_ 10 frames for a 500ms flash rate.
If it's 600ms you were doing 30mph, or 13.4112 metres/sec.
Added: Whoops - maths error, frames = time * frame rate, so 0.5s at 50Hz = 25 frames. Not all frame rates are 50Hz - verify with an LCD clock with seconds!

Nackers, I'm done for then, £60 to Mr Brown and 3 points to me.
The only saving grace is that the £60 fine will help make our roads a safer and more comfortable place to drive!!!
Thanks all.
It can't be long before senior Government minister's start finding themselves in the same boat. Maybe then common sense will start to prevail.
Trouble is, we'll all have lost our licences by then...
SWIM got 40 in a 30, accepted it, duly filled it NIP naming driver. Received usual fixed penalty offer, 3 pts 60 squid, procrastination led to them forgetting about it until 2 months later doing a paperwork spring clean. They rang prosecution asking if they could still pay, 'Sorry too late' it's now gone forward for consideration for prosecution.
They've heard nothing since and that was 2 years ago.
OK it's a gamble, do you feel lucky ?

Whats PACE - can this help me if I contest my NIP?
Have a good read of www.peppoo.com
There is loads of useful info there and lots of people who have 'been there, done that and got the T-shirt'.

Police And Criminal Evidence Act. Not sure how this would help TBH. Will ing to be proven wrong though as i have the latest PACE book.
The idea is that you give a statement admitting the offence under PACE, that evidence then becomes inadmissable in court because it wasn't done under caution.
Or something. Anyway, visit the fightback forums at www.pepipoo.com, and chances are you'll pay no fine and have no points.

There are 50 fields per second of video (Pal Frame rate) and 25 frames per second. Giving a 40 ms accuracy.
</pedantry_mode>
If you take it with a digital still camera in movie mode, many of these go at 15 frames per second - check the spec.

They will be OK, we provide them with chauffeurs.
Those making the policies and running the constabularies have no NEED to drive to earn their living, either because:-
a) They are entitled to a driver and car;
b) They live/work in London; or
c) Both!
As a result, they neither understand nor care about the importance of the car to an individuals mobility, and as a result the importance of cars/licenses to both society and the economy as a whole.
