Ourselves & many others are suffering the fate of social Neighbours from Hell & need some help. Its fairly obvious a change in the law is required to make anything work. Drafting an online petition to get a complete change in the law would seem like the best solution.

However drafting something that would be acceptable readit worthy of cause & effective should it go through is a different matter & I will need the help of the PH massive thumbup

The current system is a total waste of time at dealing with "Neighbours From Hell" can take months, relies on multiple bodies to get effective evidence, as a neighbour you will get passed from pillar to post, it's totally ineffective even if an eviction is eventually managed the tenant from hell just gets moved from one place to the next. If you happen to live next door to such a property then its just a case of a rolling problem banghead

It would be great to have input from those working in the sector involved in such issues, be they police, social housing, carers, legal types, estate agents etc & of course neighbours who have had to put up with it. The blight this issue is putting on the landscape is pretty massive.

If you happen to own a property & a local Housing Association buys next door, god forbid whatever you are liable to be on the receiving of cry This should not be the case & more powers should be in place for neighbours be they owners or renters tank

Here would be some of my key proposals to be included

A points system for tenants, similar to a driving licence, that would be taken with them from one place to the next. As a tenant, cause an issue & points are added If you have too many points your are excluded from certain properties or even thrown out from social housing altogether. However you can gain bonus points by being a good neighbour, eg improving or maintaining a garden, keeping the place tidy, helping neighbours out (especially considering many social tenants are unemployed) or just generally being a good citizen.

So using the points system a problem points gaining household gets moved on or kicked out accordingly. If the tenants caused issues with their neighbours then automatically the new applicant can only be a better points tenant. Currently it is a total lottery as the Housing Association's can't cherry pick residents. What should happen is bad tenants get moved down the housing order, good ones get moved up.

Currently the public bodies have little or no control & in reality all they can effectively do is move a problem tenant rather than curing the problem, from a neighbours point of view this is simply a nightmare.

Should a property receive a series of tenants causing issues & sufficient points are gained then the neighbours can take control, appoint new management or manage it themselves. For example where HA fails in managing its allocations or fails to act accordingly. Currently there is no system in place for neighbours to have any input in the management of the property, this needs to change.

So these would be my proposals to be included in the draft, please add input or any suggestions especially from those working in the sector or if you are or have been a neighbour effective by such issues.

The issue is that as soon as there are children involved they have to be housed. So your plan, whilst admirable, fails at the first hurdle.

The standard of behaviour that gets kids taken into care is way beyond being a bad neighbour.

So presumably the st tenants end up in private rented accommodation or are you suggesting they live on the street somewhere?

I agree something should be done, however I'm not sure just moving them is solving the problem. You aren't solving anything with your suggestion, just moving it so it's someone else's problem.

Hi, good idea, but you seam slightly fixated on it being tenants where the problem lies, when in reality it could equally apply to home owners as well. This presents an even bigger problem, as they simply cannot be just moved on. I suggest a different way of dealing with home owners may be required.

One person's "neighbour from hell" is another person's "utterly reasonable, but that busybody next door has a grudge". Evidence is kinda useful.

What do you suggest? The public gallows? Or just banishment to Gruinard?

I suggest you stop turning every thread into an argument. Do you have anything constructive to add or is it just because you're too frightened to speak up in real life?

The points system seems a good idea in principle, give the aholes an opportunity to sort themselves out or accept the consequences.

If they build up lots of bad points then they will never get moved as no one will want them and the neighbour is then stuck with them.

I think some kind of fine or something is needed, some of them knock down front garden walls to jam 4 cars on the front garden, damage the inside by changing the layout of rooms badly, don't maintain the gardens, keep loads of rubbish ect and nothing gets done about it.

I'm sorry if you seem to have taken this personally - christ alone knows why. But pause and think about it for one minute, if you can.

Your neighbour takes exception to you having an "antisocial" loud car. Or three cars. Or a dog. Or a cat. Or a child. They have nothing better to do with their time than twitch their curtains, they get a cob on about it, and they start reporting all sorts of issues - real or imagined. Do they get taken at face value, or is some kind of evidence actually required?

As for "something constructive to add" - your own contribution to this thread seems to only be to minge about the very fact that I've contributed to it, on some kind of principle. I have no idea what I may have done to upset you - your user name doesn't ring any kind of vague bell at all with me. Sorry, but...

And what ARE those "consequences"? The only consequence the neighbours care about is "Not next door to us" - but that means they get moved in next door to somebody else, doesn't it? And didn't the OP just complain about exactly that? So what...?

We need to fine them. Or maybe take their Iphones, Ipads, sky tv, newest playstation, 15year old BMW, 50inch TV off them.;)

Some kind of punishment that makes them think twice, the local authorities are not doing enough to control them.
If they treated a private rental the same way they do to our paid for by taxes homes they would get evicted or money taken off them.

Most people can approximate what is meant by a 'neighbour from hell'. Sure, some have lower thresholds than others, but it generally equates to those exhibiting anti-social behaviour, to the point that it significantly & routinely affects their neighbours' quality of life.

The odd late night-night party is one thing, as is curtain-twitching to check out visitors. But some neighbours do not care one little bit about how their actions affect others, and there has to be a reasonable means to impartially assess their behaviour, and deal with it. Don't know what a 'Gruinard' is, but that sounds like reasonable punishment for some...

Some interesting replies some of which I won't reply to. As homeowners & neighbours we have had to deal with it all, from class A & B drug dealing, abuse, unbelievable levels of noise for months on end, our cars crashed into, trashed gardens in every way possible, ABH on the premises which we were witnesses of & so involved, the list is pretty endless & we have more evidence than we can shake a stick at.

We have also had great neighbours & those I would have suggested should have received bonus points. Funnily enough one of which was an ex serviceman who was disabled.

All in all almost nothing got done on any level. This in our minds is criminal in itself, the powers that be would not use the powers they had, instead they just passed the problem from hand to hand or we were fobbed off. Eventually tenants just move on with no repercussions.

If we & others neighbours had the powers to be landlords over the property things could & would be dealt with but we don't have the legal powers that the public bodies do. Nor can we sue the public bodies for lack of procedure or failing in their duty as they have none to neighbours, this being an important point.

I am trying to restrain myself from going to right wing here but at some point people have to take their responsibilities seriously, if not you should simply be on the streets or a white container just like Calais imho. There is plenty of evidence to suggest there are far more suitable people for the properties who are on the streets.

A points based system could be very useful for private landlords too don't forget, you could even charge accordingly, I'm sure good tenants cost less!

There's quite a bit of that list which isn't "antisocial behaviour", but actual criminal crimes. Are you telling me that the police have been utterly disinterested in any of those?

Yes

All bar the ABH & car being crashed into as it was caught on CCTV & witnessed by us & we were on the phone to 999 at the time! they were charged with ABH & FTS. This was within the past month, the ABH involved a non tenant living at the premises, against the tenancy agreement but to our knowledge have had no action taken by the HA.

If the Housing Association enforced their TA's for occupancy such issues might not occur. They still have done nothing since the event.

Not all bad neighbours are in social housing or receiving benefits.

The only real solution to this is for you to earn more money and move somewhere where you are amongst like minded people (if that exists, sounds like hell to me . . . but anyway) or move to a remote little house somewhere with no neighbours.
