Paid for something I don't want.
Discussion
I made a mistake on eBay bought a fridge freezer for £40 by mistake though it was a fridge and freezer combo.
Explained to seller, he says its not his issue, but I advised would give him £5 for losses, which there would be none anyway. He is being stubborn, still won't relist and says I have to collect.
Paypal and ebay won't help, but my understanding is he can't keep my money for no reason.

You enter into a contract when purchasing. Need to be more careful.
not sure if you understand contract law, but contracts can be broken, which I have done. The précis is, what can the seller claim for damages, my understanding is can relist and 'keep' the any difference if sold for less, but can't just keep money? The Spruce goose said:

Not sure you understand contract law either. In what way have you broken the contract?Contract was formed, you have paid, item is available for you to collect. It's entirely your prerogative if you choose not to collect it but the seller is under no obligation to give you anything back and frankly in his position I'd tell you to either collect or shut up as well.

Given your attitude on this, it's no wonder the seller is saying you collect or shut up. You probably blamed him saying he didn't understand eBay?Jonno02 said:

what is the point of being so antagonistic, unless you are retarded I don't understand how you can put 2 and 2 together to make 6.I haven't blamed anyone and said it was a mistake. Worst case he keeps my money but I am asking the question on here to see if there are other options. As I stated the seller has lost nothing....
(Just to keep the internet warriors at bay it wasn't actually for me which is why the mistake was made.)

+1. You agreed to the offer, and so bought the item. It's yours and you owe the seller the agreed value - regardless of whether you choose to collect on your half of the contract (the item you've bought)
Whether you actually want the thing or not is entirely your problem. You own it. IT doesn tmatter it was on behalf of someone else, you 'made the contract'. You own it.

Have you paid him by PayPal?
If so then regardless of the moral high ground, you can file a dispute for non-delivery and reclaim your money. In fact you can even collect it and then file the non-delivery dispute as the seller will be unable to provide proof of a recognised courier delivery your item.
I'm surprised he's being so arsey - much simpler just to refund you and relist.

You're suggesting that the seller should be defrauded because his buyer didn't realise what he was buying? Good grief. As above, either collect it and give it to charity, or suck it up and walk away. If this story had been told the other way round, the consensus would have been to go to the buyer's house and hammer sausages into his lawn before bumming his dog. I get sick to death of stupid t
