First of all - I fked up - I admit it, now I need to fix it.

Stressful time car shopping. At the end of the day we thought we found the right car.

Salesman told us the engine was X spec (on more than one occasions) and it turns out it was the cheaper Y spec. A short test drive, much of which was stuck in traffic so I didn't realise the engine was a Y spec.

In summary we left a £500 deposit via debit card. No paperwork signed. Receipt stipulate the wrong PS rating for car but we didn't notice until after the transaction.

I'm going back to seem them tomorrow for refund or alternative car. Ethically, I am in the right but do I have a leg to stand on legally?

Cars with the Y spec are significantly cheaper and it is not what we want. Car value is ~£10K and through an authorised Ford dealership.

Again - I know I should have been more careful and I screwed up.

Please give me some useful and helpful advice!

First port of call should be the Dealer principle.

If they play hard ball then shame them on Facebook and twitter and I'm sure Ford UK would be very interested that their dealers are mis selling cars to customers.

Then they can UNLEARN misselling

Why not start with salesman before getting there back up over something that might be easily resolved without going mental, might be an honest mistake.

Look at the 1.0 Eco boost engine comes in different ps outputs but same body kit.

If it's a main dealer, I doubt you'll have a problem getting your deposit back if it's misdescribed. Just have a firm chat with the salesperson involved and escalate from there.

Yes, you have every leg to stand on. It sounds like a clear case of misrepresentation, which allows you the remedy of recission (ie reversing the contract).

Proving that the salesman said what he did could be tricky if you needed to though so a civil conversation with management explaining what happened and that you want your deposit back would be your best bet, I'm sure. Going straight in with ".... and I have the right to do so (etc)" is never usually the best strategy, however much it may be true.

I don't think this is URGENT. Just have a nice pleasant chat with the sales chappy, and I'm sure it will be sorted.

Calm down. They may have put the incorrect PS rating on the receipt.

OP, the answer is simple, pick the phone up/pop in and speak to the salesman and ask for clarification. Somewhat unbelievably genuine mistakes happen and once pointed out in a civil manner I would suggest that 99% of them are sorted out satisfactorily.

This must be about as straightforward as it gets.

You attempted to buy x with the car described as x and it's actually y. It's not like you've got the car and only noticed 3 months later.

Go in, explain, agree the course of action.

Crisis averted - have been in today and with a (very) mild amount of grumpiness it has been cancelled.

Still need a bloody car though!

Lesson learnt. Thanks for the comments.

You're entitled to rely on what the sales person said. It makes no difference if he made a mistake or lied you do not have the car you thought you'd bought so, just like anything else, take it back; the 'contract' is void.

If the documentation is incorrect then fine but there's no need to faff about what you thought had had bought is not the right product. If there is finance involved there might be a cooling off period.

Did you read the post directly above yours? No, I thought not.

I would bet that it's a focus, OP wants a 125 and it was a 100.

Topic finished. Thankfully.

It was even less exciting than the 125 Vs 100 Focus. It was a for a Fiesta. ~80 Vs 100 Ecoboost (ideally I want the 125). Still can't believe I screwed up so badly. The situation is slight more complicated than this but I can't be arsed to type it out.

I panicked a bit as we have had a torrid time looking for cars and most dealers have been crap to deal with and I had assumed these Guys would be similar. I do think that the salesman in this instance realised his mistake during our discussion and tried to blag it. Over the past couple of weeks of car shopping we have had;

- phone calls not returned as agreed
- salesman huffing and puffing that I dare ask for a test drive. Apparently they we due to close soon (an hour and 20 mins!)
- salesman directing every response to me despite me saying it would be my wife's car and she was asking the questions.
- travelled 40+ miles to see a "one owner car" which "was owned privately." It was previously owned by Hertz and it showed.
- blatantly ignored. I turned up in a car worth well in excess of what we would be buying so it can't be that he thinks I didn't have the money. I think it was because I had my (well behaved) kids with me.
- one dealership who refused to give me any sort of starting price for new Fiestas bought through them without visiting the dealership blah de blah.
- salesman who had no idea what stock they had
- salesman refusing to show me the V5 for some reason
- one salesman in a Peugeot dealer saying that if I had test driven a Fiesta it was pointless me driving a 208 as the Fiesta is a much better car!!!
- etc etc.

This all sounds quite minor now I've typed it out - ah bks to it all and open another bottle.

Thinking now about a new Fiesta now. Anyone used nationwide-cars.co.uk? Any other brokers recommended?
