I made a post about a friend of mine who got pulled for 107mph and prosecuted for that speed. No mitigating circumstances, does not need to drive.

The result?

5 points and £190 fine.

4 years ago this summer the old man was done for £500 and a 2 week ban for 100mph on the M4 on a sunny afternoon!

On what grounds?

On the grounds that he made the effort to question and fight every aspect of the so called justice system.
Great result Dave.

On the grounds that they screwed up the paperwork, I waited til the first witness had been sworn in, the trial had started and they presented the evidence, for me to object and the Sheriff to advise the Crown that they had no case as they had no admissable evidence.

Wouldn't have happened if I had pleaded guilty - I reckon its always worth going NG , you never know what will happen.

Great day out (eventually)

The cops should have made the case water tight...so that there were no ways to squirm out of it at court..

Oh really!!
Has it occurred to you for just one second that they might have been totally wrong and he was innocent?

Should've, could've, would've.

Police experts in speeding and drinking but need practice in filing.

As is becoming pretty apparent, though, they don't.

They still seem to try harder than with rape cases, though (6% conviction rate), which is a bit worrying.

The problem with the majority of rape cases is that they are a complete load of bollox from day one, and Stevie Wonder could see that they would never get to trial, let alone secure a conviction.

Take the most recent example I had dealings with this week. Bird goes out with male friend, gets very drunk. 4 days later (having washed bedclothes, clothing etc...) reports that she was raped by this friend. When we go round to see her, she is pissed as a fart again. We can't medical her, as we have no true consent (due to her being sozzled). States she doesn't know the friends last name. Enquiries show they were in fact school friends.

So the only evidence we have is of her apparent alcoholism and propensity to tell lies. Let's put aside whether she was raped or she wasn't, whether the drinking was a cry for help or otherwise. If you were sat on a jury, would you convict?

Sadly the above cases can be described as typical.

Screwed up paperwork means that the defendant did not do it then?
He got away with it because the system failed and not because of his innocence.
Ask him! If he is truthful he will tell you that he was speeding and was lucky
