Last year my council or rather a resident in my street discovered that the houses had been incorrectly banded for council tax since April 1993. As a direct result we were all entitled to a refund! Lurvely...

Except I only moved to my property in 2001, so I only got monies owed from overpayments I had made since this date. Fair enough. Am chasing interest owed now but thats another story.

Question is.. who should get all the money back from the overpayments made from '93 to '01. I guess the previous owners of my house.. who I don't have a forwarding address for! But I just wandered if there was some obscure property law that meant I was entitled to any overpayments made prior to my move date. I'm guessing not as it would probably also mean I'd be liable for any underpayments too!! But I just thought I'd drop a post to see if anyone knows for sure..?

Enjoy your new wealth ZJ.

After the election in May, if Labour get it then they will announce the result of the current survey on valuations of property that has been quietly taking place at the instigation of Dep PM Despot and now almost complete. The writing on the wall is that whilst there will be number of new bands, there will be a substantial increase in Council Tax.

Bet they won't shout about that on the lead up.

A bit OT but I paid all my CT (well I thought I had). Apparently £130 was left unpaid and I got a reminedr followed by a magistrates summons.

What is the power of the council to levy the £50 "costs". It hasn't gone to court. Just another income generating letter if you ask me. Thoughts?

If it has been to Court and Their Worships have made a direction to pay then LA apply and will be granted cost of taking it to Court, i.e. 50 notes.

If you have settled the arrears before any Court proceedings then no costs (unless LA take County Court action re their expenses due to arrears).

If you ever want to see money being made (other than by SCP) then go to your local Court after TV/DVLA detector have been in the area. Prosecutor up, case outlined in 30 secs, down - fine and costs (50 to 60 quid in this area.) Multiply this with a number of defendants........

They won't bother chasing the £50. It has NOT gone to court. It is a simple letter saying pay up or else. The £50 is some surious admin fee. Id like to see them justify their costs. Mind you they probably don't have to.

DVD, what I was really asking is what basis in Law can they add £50 (the council). I just called them and they claim the £50 was paid by them to the Courts for issueing Summons. I am pretty confident this is complete BS. I have asked for proof. They have declined and said they don't need to justify the costs. Pay up or get done...seems typically fair to me

Actually, what really pi55ed me off is they asked for £130 for the y/ended 31 March 2005. my entire bill is something in the order of £1500 so this represents less than 1 month, i.e March. How can this be overdue now?

Cos the council year only last 10 months for collections, the other two are to spend it.

As I said before they may try to tap you for the costs incurred in chasing the debt i.e. the summons.

twas me i would pop down to the local Justices Clerks Office and try and ascertain if in fact a summons has been issued. If not then some grounds for arguing against the 50 notes?

Probably in someone's objectives: "Add extra £50 on as many underpayments as possible".
