I've received a personal injury claim
Discussion
My Ltd is the Trustee owner of a pub (owned Leasehold).
The pub is tenanted by an independent third party with a written lease.
I have received a personal injury claim for someone claiming to have been knocked over my a member of staff sustaining multiple soft tissue damage (at 0.30 am). The claimant is unemployed.
I assume this has landed on my desk from details obtained from Land Registry.
The solicitor is based 200 miles from the incident location and claimant home, so presumably a NWNF scumbag.
Shouldn't the claim be against the tenant?
Can I tell the scumbag to jog on?

Advise the claims company of the details of the tenant. The pub is tenanted by an independent third party with a written lease.

I would call your broker and just let him know what's happening.
Just because the claimant is unemployed does not mean he does not have a valid claim caused by your tenant's actions

If you were knocked by a member of staff after being on the lash would you make a injury claim? These NWNF sharks and the something for nothing crowd should all be lined up and shot imo. Utter scum. If this moron was busy finding a job than being pissed at midnight then it wouldn't have happened.
I would be prefer to be paying some boys with baseball bats to show the pondlife what a real injury feels like. Instead the Op has to spend time and potentially money to defend himself against a piece of lifes flotsam.

Indeed. And the claimant did not seek medical attention until 18 days after the alleged incident and there was no professional recommendation of any rehabilitation action. It is claimed it was reported to the landlady at the time though.
So likely a few bruises, likely caused by the claimant themselves.
These scumbags are costing us all money ....

Was the alleged 'being knocked over by a member of staff' a result of the person being ejected from the premises?
It happened near the toilets, but having spoken to the co trustee owner it did apparently involve the doorman.Apparently the police were called at the time but took no action.

What record - and/or CCTV footage - does the tenant have of the incident?
Is the doorman trained in the role & an accredited member of any organisation?

No idea, that's all down to the tenant not the landlord. What record - and/or CCTV footage - does the tenant have of the incident?

So before the baseball bat wielding team jump in and batter everyone involved to death.
And before we can all suggest burning every lawyer at the stake.
And before PH collectively gather around to arrange the riverside ducking of everyone in the industry with no idea of the circumstances...
We have established it's nowt to do with the OP.

It's a tick box form, no doubt to cost the scumbag lawyer as little time as possible. So they tick no days off work and confirm unemployed.
It sounds like a "Claim Notification Form", or CNF. If so, the solicitor has no option but to use it for these type of cases (subject to certain exceptions). The claim will then start off in an online Portal where legal fees are fixed at a modest level. It's intended to save both sides time and money.

I actually have a job and I am regularly pissed at midnight, does that make me a moron too?Talking of being a moron, what kind of total douche thinks that it's possible to find jobs at midnight??
