Got a NIP through from West Yorkshire Police for a 42 in a 30 zone in Bradford.

However, living 140 miles away, having never actually been to Bradford and not having ever driven the offending car I'm just slightly suspect about the whole thing.

I did sell a car last year to someone, who happens to live in an extremely close proximity to where 'I' was apparently caught speeding. I've checked the car details and it's not the car I sold. I was just looking for advice as I've been turned away from a local police station, telling me to ring West Yorkshire Police ( which I've been trying for three days at various times of day to no avail).

Try replying to the NIP stating the facts. I had a similar situation in February, replied with similar details and never heard anything again. I would guess if you get through on the telephone they will want something back from you in writing.

Don't suppose you still have that slip from the DVLA acknowledging you're no longer the registered keeper?

That's the number I have been ringing. The car involved in the NIP is NOT the car I sold. The registered keeper has nominated me as the driver, I assume, using my details from the receipt of the sale of my old car in a vain attempt to get out of the NIP.

Just email them with what you have stated. They will be rubbing their hands at a potential PCOJ charge.

As a person other than keeper, you are obliged to provide any information which is in your power to give and which may lead to identification of the driver.

I'd suggest writing the SCP a letter, telling them whatever you do know ie not your car, never been to Bradford, details of the buyer, anything else that may be relevant.

Staple your letter to the s.172 form which accompanied the NIP and ensure both are delivered to the SCP more than 14 days but within 28 days from when it was served on you.

I had this a few years ago and just returned the NIP stating not me, not my car, I was miles away. I never heard from them again.

Forget the telephone. Its not that easy I`m afraid. You will have to get your pen out or type a letter stating that you were not the driver and therefore you have not signed the NIP accordingly. State where you were at the time and date relevant and list anyone or anything that can verify this.

Then , send it recorded delivery , signed for so you can prove it arrived. That way , you have a record and they have a record of your correspondence.

If you try and sort it over the telephone you will not know who the person at the other end is responsible for ( could be the cleaner !) and you`ll only find out when you get nicked for non appearance at court in a few months time !!!

That number rarely answers, they do get back to email enquiries though. You will have an electronic paper trail that you have tried to respond if you email them.

Yes, I had one too, about ten days after I sold the car. I just filled out the form on the back of the NIP, and returned it to the specified address. That was the end of it.

Why more than 14 days? After all its not as if he owes the person that has falsely accused him of something anything!

"Casualty Reduction Partnership"?
Really?

I hate this sort of psychological nonsense. It always used to be the "Central Ticket Office", but I suppose gullible people will think it's a nice, friendly helpful department who are just trying to "reduce casualties". I wish they'd all jump off a cliff.

Seems like they've bought your car then changed the reg onto another car and forgot to tell the nice people at the DVLA.

Force of habit, good practice, base covering - it's a [zero risk] belt & braces approach on the very slim chance there's been a monumental addressing SNAFU at SCP HQ and he is really due a NIP.

Responding to a NIP after 14 days ensures there's no time for fundamental errors to be corrected and new notices to be issued.

I did initially think that he could have swapped the reg over, but I've seen the photo from the camera and its a different car.

What kind of penalty would he be looking at for PCoJ if convicted?

Chris Huhne & Vicky Pryce (and many others) did time for lying about who was driving a particular vehicle at a particular time and place.
