NORTH LONDON PURCHASED FOR CASH MY BROTHER IN LAWS TVR GRIFFIN 500, ICE BLUE FOR CASH ON 15/08/02. HE HAS NOT REGISTERED THE SALE BUT IS ACCUMULATING FINES FOR BUS LANE VIOLATIONS IN NORTH LONDON.
HELP ME TRACK HIM DOWN PLEASE AS THIS IS OUT OF ORDER.

EITHER REGISTER FACE THE WRATH OF THE LAW AND THE CLUB.

did u not keep your section of the slip and send it off?

I forgot once and notified the DVLA they made a note of it

Why are you bothered by this? If the car is no longer your brother inlaws car and he has notified DVLA of the date of change of ownership, then any enquiries will eventually cease where he is concerned, when the information is updated on the PNC. Until then all he has to do is photocopy the bill of sale and have a letter drafted on his PC stating that he no longer has the vehicle under his control and it was sold to .....

The other question is, would you be bothered about it if he was accumulating gatso fines?

Is it just the bus lanes that annoy you?

just goes to show there is a responsibility to get the form in when you sell a car.
I sometimes think people foregt that driving is a privilege not a right and with it comes duties such as notifying dvla of purchase and sale.

Lets hope registers his happy purchase and your brother in law follows madcops suggestion. Get writing!

Hi Guys,

Please take note of Mike Brewer of driven.

The new registration document must be filled in at the time of sale and be sent off to the DVLA by the vendor. Mr Clarke you have broken the law already!

The vendor - that would be the person selling the car, rather than the buyer, surely?

Yep! The vendor is the seller of the car. It is amazing how many people fall into this trap of DVLA registration documents.

Both parties have to send their bits of V5 to DVLA. Obviously you can't force the purchaser to do his side of the deal (unless you had got him to sign it and posted it for him.)

However, reagrding tickets, fines etc, the relevant thing is surely the date of sale. He paid cash but wasn't there some form of receipt with the sale date and his signature and address that you can show to the authorities? If so they can pursue him for the loot rather than you. It is irritating, yes, but I'm sure it will blow over.

That isn't strictly correct - with the current type of V5 form if you sell to a private buyer they get the green part (signed by both parties I think) as proof of ownership until a new form is issued - the vendor then sends the blue part to the DVLA (which is also signed and dated by both parties) based upon the information on the blue part of the form the DVLA updates its records and issues a new form, this means that the vendor has total control of passing legal right to the new owner.

Providing that this chap's brother in law has followed this procedure all he should need to do is report it to the police who would presumably check with the DVLA (the forms do take a long time to process at the moment as I had to wait more than three months for the form on my mini)

As another precaution I always insist on a signed receipt for both parties when I buy cars privately.

Personally I wouldn't have created such a panic just sent the the demands back to the authorities with a covering letter and the receipt.

I think we could all learn from this chap's experience.

Further to what's already been said, I think it is a very serious allegation to request people to treat a car as stolen when it was in fact sold quite legitimately (it would seem) but without the required paperwork being done.

If I were the purchaser I wouldn't be very amused if I bought a car, the vendor failed to send off the V5 properly, and then started bad-mouthing me on a public forum. I might even sue.

Really? It only took 10 days for the V5 on my Griff to arrive. I was amazed!

FWIW, I had a similar experience once - I sold a car to a friend of mine, but before the DVLA reregistered it, it went through a Gatso near Carlisle at 98 mph. I received the NIP and just sent it back stating when I'd sold the car and the date I sent my bit of the V5 back. That was it - never heard any more from them.

I have only just heard about this, after getting an angry email from Nhughes. Needless to say this is all a misunderstanding, and without going into details, not my fault. Anyhow I am glad that I now have contact details for the previous owner, because I have been trying to get hold of him for a while to transfer the registration, forward me service history paperwork and a bunch of other things. In the meantime I have been to the postoffice to try to get the car registered and also I have got the tax backdated (when he sold to me it was 2 months out of date already). Anyway my point is I am not the villain, and if I have picked up a bus lane fine, then I am happy to pay it.

Can we take this as a valuable lesson about making wild accusations on the Gassing Station please.

I'm glad it's proved a useful forum for locating each other, but I'd rather people take a deep breath and pause for thought before making such silly accusations. I also object to people assuming what my view on the matter will be prior to talking to me.

The vendor changed phone numbers when he moved house recently to Paris, hence I could not contact him. He should have had mine still, but lost them during his move. Anyway, all's well that ends well, and now I have his details it should be easy enough to clear up.

What a silly way to behave. The forum includes a means of writing an email to all members - perhaps use that first next time. Saves making yourself look like a complete knob in public. Might I suggest getting your blood pressure checked.....

It turns out that the two of them both did not follow the correct procedures.

They have made contact and I believe will live happily ever after.
