I work in IT and I'm being TUPEd to my customer. This is a very good move for my colleagues and me, and we're all very happy with this, with one exception. The customer doesn't use laptops whereas we do. The customer uses virtual desktops delivered via a terminal.

In current meetings, we take our laptops which affords us all the usual flexibility of bringing ALL notes with us, and being able to make notes and present, if necessary. Although there is usually a single terminal in the meeting room, most customer personnel bring stacks of print-outs - there not being enough terminals for each meeting attendee.

We have been told that a laptop will not form any part of our TUPE arrangements but we'd like to *gently* argue that TUPE is supposed to provide us with like-for-like working conditions, and that using a laptop is "vital" (maybe too strong a word) equipment for our work.


Do I have a leg to stand on, or should I suck it up and enjoy the generally-better Ts & Cs otherwise on offer?

Not really, no. (IANAL)

They will point to their IT policy, which is not inherited / transferred when you move under TUPE.
