12yrs ago I acquired a car, parked it on private land and never Sorned it, fast forward to today and someone wants to buy what's left of it so I was going to Sorn it. On the DVLA site it states:

"You can declare your vehicle as SORN from today's date, please note that it is an offence to be the registered keeper of a vehicle that is not taxed and does not have a SORN declared. DVLA's Continuous Registration Enforcement Section may be in contact with you regarding this SORN."

What do you think my chances are of getting away with it? Any known instances of them taking action or are they just bluffing?
You'd think they'd just be happy to have their records updated, but if I thought they would take action against me then bugger that, it's staying where it is and will be scrapped one day.

SORN was introduced on January 31 1998 and applies only to vehicles taxed after that date. If your car wasn't, you have nothing to fear.

I recommissioned my Roadster an 18 year layup during which it was not taxed or SORNED and I had no trouble taxing it after its MOT

I wouldn't bother, tbh.

DVLA did seem to be a bit lax in enforcing SORN in the early days. I'd just let the buyer deal with it - your SORN would expire on the keeper change anyway.

Have you got a current-issue V5C?

Why do you want to SORN it, why not just sell it and let the buyer SORN it. He will need to SORN it anyway.

Thanks for the replies, I do have the V5 and it looks clear, but I couldn't remember if I'd declared the car scrapped or not it's been so long, hence me thinking about asking the DVLA. However I've just put the plate through their site and it doesn't come up as such so will probably be ok.

Is it a current-issue red one?

If not, then it's already part-way to dropping off their books. They've assumed it's dead, not issued at least one replacement, and not had a nudge. A keeper change will work to give 'em that nudge, though.

It's blue (I may have a few more on other long termers too though!) so thanks for the warning.
I can see a little paperwork or Sorning session coming up tonight. scratchchin

if you want to sorn it you will need to send in a V890 form from the DVLA website - if the buyer wants to sorn it they also need to send in A V890 with the V5.

A V890 is SORN, just a paper copy. I can SORN online which is much easier!

Looks like the OP may have a problem then. The key question is its status when he bought it - i.e. was it untaxed at the cut off date and did it remain so through all subsequent changes of keeper.
Assuming of course that the car was registered at the DVLA prior to 31/01/98 as that info is lacking at the moment.

Have a look at this - https://www.gov.uk/government/news/dvla-encourages...
How come you never received red replacements for the blue ones? Were the addresses on the V5Cs correct at that time?

The issue you now have is whether the buyer is on the ball and declines to do so until you have the current version.
If so, then you're faced with the potential banana skin I mentioned above.

Date of first reg was '95, I got it in '04.

Maybe I haven't had a red one because it's had no 'activity'? Address hasn't changed.

So I can either attempt to SORN it or ring the DVLA and see what they say.

It won't be a problem for them - the blue one goes back, the new keeper gets a red one.
