I signed a settlement agreement which stated that I would receive payments within 21 days of signing the contract. That time elapsed earlier this week and the solicitor advised that I should wait until Monday before kicking up a fuss. Does this seem reasonable? I don't think it's fair that they should have any leeway in the contract.

Ring payroll and ask what's going on? The tone of their response should tell you all you need to know. It just an admin issue just let it go if not warn them you will sue with all associated costs etc.

I suspect they are paying out through the normal payroll process. If the agreement due date is before the payroll date then that is probably the problem. I always try to extend the date so it can go through a normal payroll cycle.

Thanks for that advice. I have just spoken to they person who deals with our payroll and they are aware that I left on date X but not aware of any payments that are scheduled to be paid(!) They will get back to me when the senior accountant gets back from a meeting.

Also, the payroll date was a week after I signed the agreement so they could have paid it all out then. Instead they only paid me accrued salary for that month.

So you signed some form of agreement and left. You dealt with HR for this? They then are your first port of call as to why you haven't received payment.

Good point. The HR lady left the company as well before this happened - so this was handled by one of the directors. To be honest I wasn't sure who to contact (Director or Accountannt) or how I should approach the issue (something like "I signed a settlement agreement with the Company and awaiting monies which was due within 21 days of signing agreement."?)

P.S. a polite letter requesting monies has been fired off to the Director
