Long story but I'd like to keep it short.

I have a forklift on somebody's land. Said person will not speak to me but through a third party has said he wants it moved. Eventually he threatens to get a scrapman in to remove the forklift if not moved in two days.

I go to move it and I cannot as a part is missing which said person has thrown away.

I have ordered a new part but won't get it for a week. It's impossible for me to move it until then.

Said person still will not speak to me and is being a total arse. I have removed a wheel so it cannot be towed should someone have a machine capable of towing 5 tonne stuck in the ground forklift in a tight location.

I have text said person this and also stated that I will pursue him for £5000 if it disappears and have also set up a camera.

I phoned 101 and they have said he can move it on his property and possibly off of it but if a scrapman comes this is theft.

I have spare keys to said persons vehicle.

If the forklift does disappear I assume it will be a civil battle.

If I then took said persons vehicle and left name and address and a bill for a forklift to be paid and stated clearly I have taken his vehicle is this civil or criminal?

I'd highly like this to stay sensible and am just after a quick answer. I need the money from the forklift and have been doing it up to sell and have been pressed into this pretty quickly!

He would be within his rights to charge you a storage fee so its not all one way.

Tread carefully so as not make it worse.

Hands up who thinks that a somewhat relevant backstory just got glossed over massively...

So a forklift is a car? I am confused by the title in relation to the story, before we even start on the story.

I think it's just possible that point may have been passed.

Please keep us posted.

It might be more cost effective (in more ways than one) to hire a suitable low loader for an afternoon.

Why not hire a recovery truck with crane for a day and bring the merry saga to an end?

Where to start with this one??

I'm presuming the land owner and the forklift owner used to be pals, but certainly aren't pals anymore...

This is a criminal matter, it's called 'Taking without consent' commonly known as TWOC.
