PCN Question.....

Parking in my street and the surrounding area is, to put it mildly, a complete nightmare. For the last few days I have been parked with my rear bumper just over the dotted boundary of a disabled parking space, with another car parked behind comfortably contained within the rest of the space (it's big enough for a Maybach!).

This afternoon I went to my car and noticed that I've been blessed with a PCN. It's probably worth mentioning that:

1. The space had been vacated by the blue-badge holder.
2. My car was seen by at least two traffic wardens who did not deem my parking worthy of a ticket.
3. The warden that issued the PCN got the name of my street wrong.

So - I put it to the PH massive, what to do?

I take it we are talking about there being plenty of room for a Blue badge holder to still park easily, in which case, unless anyone has any better ideas:-

How about a letter to the issuer stating that this could not possibly have been you car as it was not parked on this street at the time the ticket was issued, it was parked on such and such street.

Another one, which I would love to know if I am right or not about, is if it is overhang of the car or the wheels which determines if the car is wrongly parked. My car is 4.797m long so I can easily overhang the edge of a double yellow with the wheels on 'clear parking'. I once asked a passing warden about this and showed him my car which was doing just this - he said it was where the wheels were that counted.

Absolutely - I actually parked whilst the disabled space was occupied by a blue badge holder. I do not advocate the mis-use of disabled spaces.

I'm not sure if any of my wheel was over the line or not. I'll dispute it anyway, and see what happens.

I would have though that the wrong street name on the ticket cancels the offence out. You could not have been parked at the location named as you were parked elsewhere at that point in time. Therefore, you could not have committed the offence since you where not parked where they say your where.

Write to them informing them that you were NOT parked at the stated location at that time, but do NOT disclose the location where you were parked otherwise they might just re-issue with the details you provided.

Innocent until proven guilty still aplies in this case.
