Paternity Leave and Holiday Questions

Hello folks,

I'm a teacher, working in the state sector in Scotland. Yes, I know I get loads of holidays, but this month I've had a bit of a unique problem. I have a February break, from this Thursday to next Tuesday. I took last week for paternity, and this week (over the holiday). However, this week I only get £130 statutory paternity leave, where as if I took it as the normal holiday i'd have received full pay. I can only take full weeks at a time of paternity. I'm told by HR that I won't get my holiday entitlement back. Does this sound right?

The maternity policy states that I'd have received a maximum of 40 days back in this situation, but being a man means I don't. Inequality much?

It's not clear which dates you had booked/allocated as annual leave and paternity leave.

Do they overlap? If so why didn't you amend you annual leave request? In theory if you received SPP for the period rather than normal salary then you should get that part of annual leave back. If it has been allocated as annual leave then you should have been paid accordingly.

In teaching my annual leave is set in stone, I need to take it when they say. We get lots of holidays, but they're all dictated.

So week one of paternity was fine, however week two (the end of it) is my February break (annual leave) but I'm on week two of paternity leave. It means that I get paid £130 for statutory paternity instead of £700 and odds...

Assuming payroll hasn't run for February and you are paid at end of month does it make more financial sense to cancel the 2nd week of paternity leave?

When I took paternity, did one week plus one week of normal half term holiday as it made more financial sense.
