I presume that many have done this, but to whom does one address the summons?

They have offices in Richmond. Probably a better bet than going after them in Luxemborg.

I tried similar with Amazon but had no luck at all. When i phoned them they gave me an address in Slough as their uk address, and the person i spoke to was there in Slough too so it seemed legit. Their website has a .co.uk address too. I sent a letter before action to their Slough addresss and they replied etc no problems so far.
However as soon as the court sent the papers through they decided that they were in the netherlands rather than the uk. Nice of them to wait till action had started before mentioning this.

I dont know, but i would not be surprised if Ebay try a similar thing.

The problem with all of this is it costs money to start the court process and actually find out any information. imo having a .co.uk web address and offices in the uk means a uk branch of that company but not in the eyes of the law unfortunately.

My advice would be to have a word with a solicitor before doing anything, it may well be cheaper in the long run.

I've asked them for a named individual and their address.

If they don't play nice I'll let my cc company kick them.

If they do give me a contact name then they will be issued with a summons.

How have they "wronged" you ? Got to say the general consensus is that they are squeaky clean and correct !

^This. It's all in the eBay user agreement.

That's also the identity of the defendant you should name in any proceedings.
