Has my mate got lucky??
Discussion
A friend I've just been away with was telling me how he got stopped late one evening a week before Christmas, just outside town on a dual- carriageway which I know as he said has a rather daft 30mph limit. the rozzers were tucked away at the end of this stretch and "got" him at 57mph
After passing a breath test ( late, just before xmas) they started to take details and said that it would probably go to court as it was that much over the limit. My mate then said about the lack of speed signs along the road (he checked next day and there is none he could see) and also asked what the fine might be. The copper said it depends on your salary at which point my mate said he was self-employed. Policeman then says tell them you earn less than you do and get a smaller fine.
At this point, my mate finishes the conversation by adding, thanks for that, I've recorded that on my phone so I am sure the court will be interested in what you say to avoid a larger fine.
The officer gives him a look as if he doesn't know if he's joking or not and mate goes on his way.
He still hasn't received anything in the post yet so has this one "disappeared" or can you get NIP long after the date you were stopped- is there a cut-off time?

If there are no signs of a speed limit change why would it be 30mph? He must have passed a speed limit change at some point. After that, provided there are street lights, no repeaters are needed, therefore if no repeaters assume 30. As for the rest, the police have 6 months to lay the evidence before the court to obtain a summons. No NIP needed, he has already had his NIP verbally.
Um, is it not the case that an NIP is usually only when you were caught by A camera and thus you won't receive one if you are actually stopped? I thought an NIP was in general in lieu of actually interacting with a human police officer?
So it's just a six month wait for the summons?
Or have I got the wrong end of the stick?

Yes I know, the copper was probably just trying to ease the pain but my mate was -I don't know- pissed off at the stop, cross with something else, seen a way out, who knows, nobody's perfect and he is a good chap actually.
Anyway, there are street lights on this stretch but not urban area, its just off the motorway and people have been "done" there before but he's from out of the area so wouldn't have known its a hotspot. I will have to check signage myself!
Ok, so it might still be a letter through the post box then!

NIP would have been given verbally at the time & a follow-up in writing is not required. Perhaps he ought to check his phone.oceanview said:

May be off the mark here, but sounds like a half-term classic. After passing a breath test ( late, just before xmas) they started to take details and said that it would probably go to court as it was that much over the limit. Your mate is a d
head and I hope he gets his summons, they're good coppers and bad coppers and it sounds like your mate got a good one that tried to help him out even though he was breaking the law and he rubbed there nose in it.
Tell your mate to enjoy the fine.
Totally agree...what a bellend. Copper tries to do help him out and he's a total pr!ck about it.

Why would the policeman recommend that the speeder to lie to the court?
Is the policeman interfering with justice and what would perhaps have been a larger fine? a bit like an accountant saying to his client that he should only declare half of your earnings to get you a lesser fine?
If the speeder was being done for excess speed telling him to lie to the courts over anything to get a lesser fine must be an abuse of position or perverting the course of justice?
I'm taking no sides in this and post the above as its an arguable issue - interesting to discuss.

The police have 6 months to institute proceedings. If you get the Metropolitan Police and they issue proceedings using a Written Charge and Single Justice Procedure Notice then you may find that they don't know what they are doing with the "new" procedure and the case is later dropped when the CPS gets their hands on it following a not guilty plea. Your client then walks away from a speeding offence notwithstanding that he was accused of driving at 113 mph. He would have been verbal NIP'd at the time of the offence. The Police have 6 months to start proceedings so still a little while to wait yet.
No NIP needs to be sent via post if given verbally at the roadside. In Hants if the speed is too high to be dealt with by means of an FPN we don't even given anything to the driver at the roadside. Verbal NIP, report for offence then issue a SJPN for the offence (Within 6 months) The SJPN may not arrive within 6 months but if Police started proceedings in this time then all above board.
