Long story short. Bought a used car from a dealer professional enough place big pitch on a main road into town.

Less than an hour later the oil cooler let's go oil everywhere.

Go back to them. Nothing I can do you'll have to email the director with complaints.

Now he's saying that as they gave a discount for other mostly cosmetic issues I picked up on her feels that they are not liable but is willing to pay 50% as a good will gesture. If I let him sort it at a cost of £1300.

Now today I called the main dealer who quoted £800. For the same job so it's clear he's just taking the piss.

As far as I can see he is liable to pay the cost or give me a refund in full?

What are the laws and rights that I can quote when I send him the next email telling him I'm taking him to court if he won't pay?

Many thanks.

One thing I am 100% sure of is them giving a discount is entirely irrelevant to your situation and the dealer using it as a way to try and reduce their responsibility does not bode well for how they handle the issue from hereon in.

They will be completely responsible, after an hour I think it's pretty clear the issue was there at time of purchase. Be polite but just say it's down to them to fix and that they can get it fixed much cheaper at the main dealer.

It's a 2007 90kmiles car.

Around the £14k Mark.

I investigated the situation my self and have given them the choice of

1 pay the bill I send them for the repair.

2 collect the car and refund me in full

3 see me in court which he must know he will lose.

Don't pay the bill as their is no incentive for them to reimburse you.

I understand that but I need a working car and it could drag on for a long time.

I think I might just remind him that it will get a long more expensive for him when I start claiming for hire cars and cleaning of my drive way and lost earnings.

With a response like that I would just reject it and get a full refund, what happens if something else goes wrong later?

I gave him the option of repairing it.

I gave home the option of making my invoice to have it fixed.

I gave him the option of it back for a full refund he has said no to all of the above.

His only offer is to have the part fitted for me foc if I pay for all the parts and oil etc.

He will be receiving a court summons next week.

If I thought for a minute that I'd ever see a penny I'd just dump it back down there but then I'd have no car and no cash.

Sent a county court claim for £25 from the sofa and not risk a brick through the front window? Probably better smile

Why not just use one of your other cars while this is sorted?
