Evening all,

Looking for a bit of advise re the issue I've had with an eBay purchase recently.

I purchased a set of Mx5 seats with door cards and a steering wheel for £350.00. I asked for HD picture beforehand and if there were any defects.

The eBay description stated "THIS INTERIOR IN GREAT CONDITION". His pictures via text showed a small amount of damage to the to drivers side bolster but nothing else of note.

I decided to go ahead with the purchase but upon delivery there was damage to much of the leather, the steering wheel and the door cards. I contacted them immediately asking for a refund with all reasons and pictures. After much ignoring and contact they finally agreed via eBay a full refund. Nearly 6 weeks later they finally collected them (apparently from the owner of the business). He saw the damage, assured me that he would refund via PayPal in the morning (original payment method). No payment made but when logging into eBay I received this message;

"Good afternoon Joe, good to meet you last night.
In dealing with your concerns over this purchase, (and following my collection of the item last night), I was unaware until today of correspondence you have had with our eBay manager Damian on a personal level.

I am in the process of compiling an electronic document with the relevant photographs and messages exchanged between you both, and will be forwarding them to you as a matter of urgency early next week in order to facilitate the Resolution Center further looking into the matter.

It is my opinion that your item was delivered to you as described and advertised. We are happy to refund your money to you less postage costs of £28, plus a 25% handling charge as stated on the listing.

Hoping we can resolve this matter quickly,

Kind regards,
  • **"
Obviously I am not happy with this and want the full refund that I requested and was agreed.

What should I do moving forward?

eBay dispute was opened when not hearing from them.
It was paid for via PayPal.
I have pictures of all damage and massive difference in description.

All advise welcome smile

Don't close your dispute, escalate when you can and you should get a full refund based on their lack of honesty in the description.

Did you take pictures of the damage?

As above - DO NOT CLOSE THE CASE under any circumstances until you have the full refund.

I'm sure you'll be ok, paypal/ebay always go with the buyer even when their complaints are flatout lies. In your case, with the items not being as described I would expect ebay to side with you and a paypal refund shortly after. The terms he's mentioned in his ad, handling charges etc will be ignored as well.

ebay will refund you full amount, if the advert was genuinely misrepresented then shouldn't be an issue.

Unfortunately it is not as simple as this. Ebay resolution centre will ask for the item to be returned to the seller with 'proof of postage'. As the item has already been collected this is not going to be possible. [This could be why they waited 6 weeks and then collected it in person.]
This will probably cause a major problem as Ebay do not seem to apply common sense or have any human input when it comes to their resolution centre - it's just a case of 'computer says "no"'.
Good luck but I wouldn't get too excited.

For the same reason you should NEVER EVER use Paypal for sold & collected items, you have to RETURN items using a courier with an online tracking number in order to get a full refund.

I suspect the seller knows this and is now scamming you for a quarter of the value of the sale plus collection charge!
Paypal won't help you because you didn't follow their T&C's.

Good luck.

What OP does have though, is a confirmation via eBay messages that the seller has the item back.

I agree, the "system" will not work for him..... But if you can get an agent on the phone or via chat, you have a fair chance of getting the full lot back.

I had an issue with a bike rack, damaged in transit, one bolt sheared. Seller sent two bolt (neither of which were the right one) before he gave up, spat his dummy and arranged for the manufacturer to collect it and (crucially) deliver it back to the manufacturer (not the seller).

Eventually got there by getting someone on chat to look through all messages and emailing scan of courier collection docket.

OP needs to speak to someone at eBay!

eBay are actually incredibly helpful on the phone. My account was compromised once, and a chap from eBay called me from the US and walked me through the reset process.

If you wanted to play dirty you could send them back a heavy package of st/bricks.

Even a recorded letter. Then use that as postage tracking return. Scam the scammer.
