Burger van in a layby need mot or not?
Discussion
Does a burger van (Mercedes Sprinter) require an mot and to be taxed etc if permanently sited in a layby to a trunk road in Scotland? BEAR Scotland have given there approval and now a planning application is to be made, however I think it will need to be road legal, the applicant thinks Not! Who is right
I think it depends entirely on whether the burger van is classed as a vehicle or a structure?
It also depends on what the planning permission says.
If the council have given planning permission for a mobile/movable van to be parked in the layby to serve food then I would imagine it must be roadworthy and MOT'd/insured etc.
If the council have given permission for a burger van to be in the layby and are classing it as some form of structure or fixture, then I guess it could be a rotten dilapidated unroadworthy van and that would be fine.

We have this on our road....100% not roadworthy and hasn't moved in about 10 years so i guess it's a structure rather than a vehicle now?

I think the vehicle in question will be parked on the roadway or on the verge of the road. It is my understanding that the verge is classed part of the highway, just not sure when it comes to layby. I have been asked to submit a planning application for this, and don't want to waste someone else's funds if it's to be a non starter, nor do I wish to draw attention to any possible issues with the authorities.
If it's a motor vehicle and it's used on a road (and unless it's subject to one of the exemptions listed here), it'll need an MOT.
If it is (or ever was) a mechanically propelled vehicle and it's used (or kept) on a road maintained at public expense (and unless it's subject to one of the exemptions listed here), it'll need tax.
If it's a motor vehicle and it's used on a road (or other public place), it'll need insurance.

Pretty much as I thought. If it is (or ever was) a mechanically propelled vehicle and it's used (or kept) on a road maintained at public expense (and unless it's subject to one of the exemptions listed here), it'll need tax.

Went to school on one of those, but I digress.Do people still take a chance and eat from these vans.
I always remember one of the delivery drivers telling us he stopped at a burger van parked in a lay-by on a long way back one evening.
He couldn't see anyone so was about to walk back to his vehicle. When a man emerged from the hedge behind the van and rubbed his hands on the grass.
The man then said "What can a get ya boy?"
He had clearly been for a jimmy or riddle in the hedge.
Never had burger van food since and don't intend to.

True but they will also have to have hot water & be inspected by environment health you would hope any vender wouldn't be daft enough to do something like thatI always remember one of the delivery drivers telling us he stopped at a burger van parked in a lay-by on a long way back one evening.

Don't ever look in the kitchens of food establishments or ready meals or pre-packaged food or freshly made food or even fruit as all sorts have been crawling over it and did that immigrant fruit picker wash their hands?
