A collegue has just received a letter notifying him of 3 points for jumping a traffic light.

On the attached FAQ sheet that came with the NIP, it says the following:


"Can I have a copy of the photograph?
This is a 'summary offence' and no advance disclosure is required. The evidence is to support a prosecution case. However the photograph is normally of the rear of the vehicle and will not assist you in identifying the driver."


What is this saying? If we want to see the
photographs, I was under the impression that they had to send them.

The offence is traffic light - fail to comply.
I'm interested to see where they got him from, and how.

Perfectly reasonable to ask for the photograph.

I take it this is the Conditional Offer - pay 60 collect 3 points within 28 days then matter all wrapped up?

If it is there is no obligation to disclose ANY evidence at this stage but some CPS do disclose on request. This case it will a photo of the rear of the car having jumped the lights and as such not much use to ID driver?

It is at the stage where a summons is issed that full disclosure of evidence has to take place.

Might be a cloned plate on a not-your-car? Photo would help then.

It’s always worth asking for the photo, saying that you need I to help asatain who the driver was.

But technically they do not need to hand it over till
It gets to court and you plead not guilty.

Might be better to ask for the photo because "you're unsure if your car was in the area at the time"

Worked every time for me.

Happened to me. Photo turned out to be a saloon, mine was an estate.

My copper mate says that going through a red light is ok if you thought it was more dangerous to stop safely, however that would depend on circumstance and how long the light had been red etc.
