Chaps,

I'm sure this would've been aired before, but I can't find any other refs to it.

I think I got snapped on the M25 a week ago. No NIP has turned up yet, but I am expecting it to.

I was going to the Airport with the missus, on our way to Italy. When/if the NIP turns up, what would happen if I were to name her as the driver.....and then subsequently she were to name me back again, and then I name her again..... ad infinitum. Would they eventually drop it....or would they make us both turn up to court and testify?

If(?) it went to court the registered keeper would probably take the rap as s/he would be the most likely driver. IMO

Two young car thieves escaped prosecution. They were caught outside the car.

Each accused the other of driving. Each denied.

Suppose they were done for theft, but no driving charges were made.....

at the end of the day It all comes down to bottel as the Bibs will tell you and you may crack.

If you got the bottel to ride the train to the last stop then there a chace you win.

Its easy to escape prosecution for silly crimes like theft/burglary/mugging, much harder to get away with the heinous offence of driving your car at 36mph on the wrong road in your legal car...Just make sure the car you are driving is nicked and you should be fine.

Along with 'innocent until proven guilty', both of these appear to be ignored in motoring offences.

I know this; You know this - that is why I put IMO... a magistrate would probably make a decision against the registered keeper and the defendent would have to appeal the conviction if they thought it unjust.

Unfortunately the burden of proof that you're innocent rests with you. Ie, the prosecution don't have to proove your guilt. So much for magna carter and ehcr! Lets hope we can get our money back later on.

Maybe the car was being driven by an italian driver. All you have to do to meet your obligations is name the driver, that and no more.

You are wrong. The question was what if two people point the finger at each other. In such a case in order to convict, the burden is beyond reasonable doubt.
