Crack in downpipe

How bad is it really to have a crack in the downpipe and not replace it. Well i say crack, but the pipe has disconnected itself from the end can. The bike is now v.loud, but it looks as if it might of just happened, so if plod pulls me over i can say "that i tried to repair it, but the potholes in the road cracked it again; i'll get it done now..."
Don't know but the silencer fell off my Alfa as I was getting on a ferry a few years ago. I drove all the way down to Italy like that and then got a small backstreet garage to replace it for a fraction of the UK price..
Apart from it being quite loud I don't think it will do the bike any harm. Like you said, blame it on the roads.
