My 13 yr old son went out for a bike ride today and was longer than expected, as he has learning difficulties I got concerned and went looking for him, I found him up at our local park pushing his bike home and crying, I asked him what was wrong and he told me a group of lads cornered him and someone punched him in the face, I got him in the car and found the kids he was talking about and went straight over to them, the lad that hit him rode off before I could grab him but one lad started getting lippy with me so I got right in his face untill he backed down.
I'm now concerned that I may have gone a bit far, although I wanted to knock him into next week I never put a finger on him. Could I have grabbed hold of him or is that a big no no?
cheers
Dan

Technically it could be classed as assault but i'd say anyone would be hard pressed to put it against you. Nowt wrong with getting in their face, problem is they know you can't lay as finger on them

Shouldnt be a problem if you didnt touch him - did they try and have your lads bike off him - if yes, insist on reporting the attempted robbery

I think you'll be fine.

I still have an incisor that's a different colour to the others from where I got a pasting in similar circumstances (not got any learning difficulties, just a lack of situational awareness at the time to register I was about to get done over). Regardless of anything else, you are 100% morally in the right (and still would be if the little st were a damp stain on the ground). It's done now. You'll probably hear no more about it. Make sure your kid's ok and keep an eye on him in case he's nervous about going out on his own in the future.

One day they'll find the wrong person and learn that's not something to rely on. It will not be a pleasant lesson.

Thanks for the quick reply. If I'd have done that at his age I would have expected a clip round the earhole from the lads father and when I went home got another one from my Dad.

Go speak to the parents, school etc. Cant see it going down well with them, hitting a boy with learning difficulties. Your alot more self controlled than me, id have laid him out.

In an ideal world that would work, but unfortunately the parents/school either wont or are unable to do anything. frown

Absolutely this, you handled it the best way you could! You went as far as you could, without dropping yourself in the hot water.

The risk is that the little darlings will concoct a story about being threatened & that one of them sustains an injury - either self inflicted or from that day - that they claim was caused by you assaulting them.

Happened to a colleague & went all the way to Crown Court. During the trial - which was not going well for him & his own barrister had told him that it was very probable he would be convicted - they were overheard in a cafe by the cafe owner discussing how they'd stitched up a policeman. Cafe owner reported it & went to court. Trial stopped & judge threw it out.
What happened to them you might ask? Nothing.

With everyone now in possession of cameraphones you might have an even more difficult time if your actions have been filmed.

At least they know about it and can look out for future bullying to other kids.

The police also need to know about the assault.

Justice these days seems to be name and shame people on Facebook

Hope your son is ok. It is not just the physical impact, it is the emotional impact too.

Don't think I'd have been as controlled as you frown

The parental protection instinct is a strong one.

I remember my brother coming home one day on his bike, in tears. He'd been set on by some local scrotes at the local scrappy.

My father grabbed a length of 3 by 2 from the garage, took me and my brother back down the scrappy's, told me to sit in the car whilst he went in with my brother to hunt out the scrotes.

5 minutes later, I saw a pack of three scrotes absolutely tearing passed as they scarpered back to their homes, with my Father and Brother a minute behind.

My father had gone into the scrappy and just flushed them out. He was furious. Never seen him like it before or since. They did well to run.

But this was then (40 years ago), you went about as far as you can these days and I applaud you for it.

Note: He never touched the kids, they ran as soon as they saw him. But I hope they thought twice about picking on the next defenceless young kid.
