Stuck in the open position??.. sounds more like a mechanical fault than electrical to me,
Try adjusting/lubricating the latching mechanism on the boot lip. When the boot is open it should be in the open position, you can simulate the locking action by pushing down on the stricker that the boot lid should hit when closed. Then push the badge for the actuator to flick it back open (the lid doesn't have to be closed for the actuator to work).

The swivelling fork that grabs the pin has a spring loaded pawl that locks it in the closed position. I suspect that the pawl is either seized or has a broken spring.

Not relevant to you but might help others who find this thread:

Don't over-tighten the Cerb badge, otherwise the boot will open randomly on track, or when you reach a certain speed on road.

Claiming that it is a speed activated spoiler doesn't seem to cut it with my GF.

All fixed ,the cable to the catch from the switch had gone out of adjustment so readjusted it and its working now ,had to remove some of the boot carpet to get to it.
