Hello,

I am part exchanging my car and the dealer has had a look around the car and I don't think he has noticed that there are some minor damages but would require new parts e.g. front bumper.

Can the dealer bring legal issues? Or is it the full responsibility of the dealer to ensure they have spotted any issues?

As long as you don't mislead the dealer (i.e. telling him the engine is in great condition when you know it is isn't, or something), it's up to them to examine the car and identify any issues. I am pretty sure any half competent dealer would notice bodywork damage however and reflect it in the price ...

Yeah I haven't said there's no damage, but I haven't said there is damage either as they haven't asked me.
I did some minor touch up and sprayed some white cracks black this was a self DIY so I don't have to pay to repair as it's not so bad.
Would this still be up to the dealer to examine and see?

remember, if they ask you, "has it been in an accident?" and you say "no" and clearly you know it has, when you sign over the trade in sheet it would have terms and conditions probably stating you are liable for the cost or the price difference between A1 condition and fair to poor

Well unless they are blind or its their 1st trade in they would have noticed and based your trade in price accordingly, out of interest did you get what you thought it was worth against what you got/book price etc?

I got couple 100 pounds less. The dealer had a look around and said "there are some minor issues" so I assume he has seen the damage but I was surprised as he only knocked off couple 100 from asking price.

There is a document I might have to sign where it asks if I've been in an accident and had a loss of claim.
So it has been in an accident but because I haven't been through insurance there was no loss of claim, so I would say 'yes' or 'no' for that?

No.

Not sure it's any of the dealer's business either. Either he wants the car as is or not.

If they have viewed the car and appraised it then i don't see the issue.

The car is 3 years old with very low mileage. I just don't want them to come back to me and be like look you didn't tell us about the damage or you tried to hide it from us. Where as the DIY fix was so it wouldn't look bad whilst I was still thinking of keeping the car. They have not asked me if there are any damages.

So am I in the right to say I am not in the wrong and they can't take any legal actions against me or ask to pay more if they failed to spot it?

yep..seen it all before , wd40 on a scratch , parked near a wall , freshly washed so its still wet
