I moved into my new flat ( 1 of 6 in the same building) two days ago

Last night, there was banging on all of my windows front and rear (rear is my bedroom). I go out an find a shirtless dude staggering around banging on everyone's windows. This went on for 10 mins so my missus rang the police.

Before they arrived I heard the sound of cracking plastic, looked out to the courtyard to find this guy trying to rip the wing mirror off my Monaro, I opened the window and shouted at him, and he ran at me (managed to close the window before he hit it).

He was outside making more noise, the missus insisted I didn't go out.

Police arrive and arrest him.

Check on the other car, Audi A3 Cab parked on the road outside the flat, he's keyed the bonnet, walked over the roof and ripped the heated and auto tinting wing mirror glass out.

The Golf has a foot print on the drivers door window where he tried to kick it in.

All three cars have been swabbed as his blood is everywhere.

The Monaro and Golf are ok, but the Audi needs work to get it back to mint, the missus went for Vegas Yellow which was an optional extra, so im assuming that it's going to cost a bit to respray.

Three questions:

It was obviously him - where do we go from here, we gave statements to the police at 4am this morning, do I go through the insurance or wait to see if he's forced to pay up?

Should I tell our joint landlord about this?

I noticed his car had a flat tyre this morning, and there is a empty bottle of scotch on the passenger seat so im assuming he drove home pissed and the police didn't notice that when they were checking all the cars in our road this morning, should I report it ?

Thanks in advance,

Andy

Is he likely to be able to pay? Or is it going to be 50p a week for the next 20 years?

Yes. Worst result, nothing happens. Best result, they get evicted.

Get your insurer involved - it'll not be a cheap fix and I doubt very much you'll be able to get him to pay anything up front to repair it.

When you speak to the insurers, give them his details, name, address etc and tell them he was arrested - they'll be able to get the police report once (if) he has been prosecuted. They can then try and recover their outlay from him if it's worthwhile.

I'd definitely be telling the landlord - the guy sounds like a complete prick and I wouldn't want to live in the same block as him. I suspect this won't be the last time he does something like this.

I'd also tell the police about his vehicle, although I doubt they'll be able to do anything about it now.

Do you have a crime number for the damage to your vehicles that can be related back to that night.

If not get one and get it on record, soon.

Otherwise, its makes it that little bit that more difficult to prove a link between his arrest and your damage.

Thanks all

He has been charged with criminal damage because of the £££ of damage - the policeman said he would phone back later with details later.

I'll phone the insurer and take a trip to Audi in the morning.

Reported all of it to the landlord, waiting for a reply.

I now have a large bat and a can of mace indoors

Never felt so vulnerable in all my life, and i'm not small or reserved!

Do you have legal cover on the car, can you use it to help file a case against him for the damage either privately or through the criminal damage process. Maybe even the insurance co will chase him after you claim.

I'm not sure the above but something needs to be done as these people seem just get a £120 fine and told to pay £200 towards your damage.

Random story; I was in my mates car recently and we were pulled over. "Random checks"

We're both early 30s, leaving the park, in his new C-Class Coupe.

The cop wants a look in the boot

"Whits this basebaw bat fur then son?"

"Playing baseball"

"Don't get funny wi' me wee man (we were both significantly taller, though not wider than this chap), whit yeez goat a bat fur"

I'd never encountered a policeman this neddy before

"It's for playing baseball, look in the bag"

He opens the bag, there are 2 baseball gloves and a few balls

"Aye, well, youz are awright this time then, on your way"

My mate said "Yeah, just a minute officer, we'll take a note of your number, ta"

"Aye, well (getting upset) whit do youz need that fur, eh? Whit youz gonnae dae, huh?"

We never said anything, never did anything, just got in the car and left.

So yeah, carrying a baseball bat isn't allowed unless you have a glove and ball with you, then it's OK.
To be fair to the copper baseball isn't exactly a common game in the UK. He asked, you answered, end of story.

I'm not sure why you bothered to take his number but good luck....

Indeed, it was more the tone in which he asked, and if you'd read it, I didn't take his number. Good luck? Thanks smile

My mate only staye less than a ten minute drive from the park, but we decided against walking as walking about with a baseball bat in Paisley is probably a good way to get yourself lifted! laugh
Ah Paisley, that'll be why then. I don't think the accent translates properly to those that aren't Scots. It's the equivalent of a white-cider-drinking-string-vest-wearing-chav poking around your car with an attitude, rather than a somewhat professional attitude from police you'd expect.

My OH's friend who is a police officer was assaulted twice in a week in Paisley. Once by a pub fight that spilled out onto the street and the other by a woman no less than 60 years of age that threw herself onto the bonnet of their car, out of the blue, and started spitting on them when they got out and gave him a black eye. Crazy place.

And seeing the damage is making my piss boil, OP.

OP, have you spoken to many of the neighbours? Does he have previous for this sort of thing?
He has been there for 6 months, always been nice apparently, I met him very briefly the day he moved in, shook hands and said hello etc.

All the neighbours say its a real quiet road, never any trouble at all.

Police tell me he has no previous convictions or arrests.

Sounds like a bad drunk.
Plenty about I'm afraid. Perfectly normal upstanding people but once they've had a drink they turn into raving lunies.
Had a mate like that. Lovely quiet down to earth bloke when sober but wanted to fight the world for just being there when drunk.
I refused to go out with him in the end until he got himself sorted. Has now bee tee total for 15 years and a nice person to socialise with now.
Some people are just not compatible with alcohol.

Never the less the OP's neighbour needs to caugh up for damage and get some help!

You'd be wise to dispose of that. You could open yourself up to being prosecuted under the Firearms Act 1968 Section 5.1(b)

Seems the Police are taking this criminal damage seriously which is good!

A kid threw a bottle at my car once, I was driving down a high street and he was very drunk. It hit the top of the door frame and roof, and dented both. I claimed on the insurance and had to pay the £500 excess. Kid was arrested as I'd stopped and got hold of him. He went to court, and got nicked for criminal damage. He ended up having to pay me my £500 back. The first cheque from the court was for £2.50, after about another 6 cheques...they stopped coming completely. Don't hold your breath for repayment OP, sorry.
