We're a small Ltd company, in August we will be taking on a temp for 6 months using a local recruitment agency.

The nature of the role means that the candidate will be viewing sone sensitive company/client information. The type of role also means that they could possibly move on to a competitor company.

To ensure we're protecting our interests, what type of agreement would we need to get in place to ensure internal data sharing is minimised.

If it were a full time employee, we would issue a confidentiality, NDS and non-compete contract. However I'm unsure given the temp nature what's acceptable.

Secondly, would we approach an independent HR specialist or a commercial solicitor to draw up documents?

TIA

non-compete contracts aren't worth the paper they are written on.

I know that from experience. Walked away from my old company and took 90% of the clients with me... although the non compete clause was one sentence within my contract.

However, I still feel that an agreement should be in place, to at least place some doubt in someone doing anything silly.

So what would have stopped you?

A clause that was in-depth and on the surface, looked like it wouldn't be worth my while taking clients without severe repercussions.

Not true.
