Posting for a fiend...friend whatever..

They put an order in for a product via email/feedback form whatsitsname but later the same day sent a cancellation via the same channel as they found the product wasnt what they wanted.

Was told today that the company has sent em a confirmation order on the thing they no longer want, but they didnt see it until today as theyve not been into their email for a few days and have immediately re-sent the cancellation of the order again and a brief note giving an explanation.

Question: Can payment for the item/s be forced? Or can the company go jump in the river as the cancellation was sent the same day?
I can only think the company they sent the order to either didnt get the cancellation or they ignored it.

So wheres the friend stand? personally im not sure so ive posted it here for you legal eagles.

Distance Selling Legislation is what you want to Google for.

Dont think the company can insist on payment...

The supplier has not got a leg to stand on.

The end.

(The credit card company will recredit the punter at the drop of a hat, double quick.)

This wouldn't be Dabs.com would it? Hell of a time with them trying to cancel a printer I ordered.

Eventually got it sorted, but I won't be going back.

No mate.
Just have to wait and see what they come back with now theyve sent off the second cancellation.
Possible problem was the item was a special order and they may play up.
Time will tell....but as they dont have the friends credit card details theyll be a bit pushed anyway id say.

Special orders are different ito The Distance Selling Regs - the vendor is under no obligation to acquiesce to a cancellation order following delivery if the punter was made aware of the fact it was indeed a special order beforehand.

Thanks for that Deres. I got them to phone and speak to someone who told em the item hadnt yet been constructed and that the latest cancellation would be taken as just that...so looks like theyre ok.
